MANILA, Philippines – Idineklara ng Supreme Court (SC) na balido ang ipinagkaloob na amnesty kay dating senador Antonio Trillanes IV at simabing labag sa saligang batas ang pagbawi nito ni dating Pangulong Rodrigo Duterte sa pamamagitan ng Proclamation No. 537.
Nakasaad sa Supreme Court En Banc na hindi basta mababawi ng pangulo ang ipinagkaloob na amnesty dahil kailangan ito ng pagsang-ayon ng Congress.
Sa ponente ni Associate Justice Maria Filomena D. Singh na pinahahalagahan ng SC ang Bill of Rights at iginiit na walang sinuman ang mas mataas sa batas.
“The Court also grounded its ruling on the primacy of the Bill of Rights and reaffirmed that neither the Government nor any of its officials, including the President, are above the law.The Court ruled that the revocation of Trillanes’ amnesty long after it became final and without prior notice violated his constitutional right to due process.”
Dagdag ng Korte Suprema, ang Proclamation No. 572 ay labag sa constitutional rights laban sa ex post facto laws at double jeopardy.
Magugunita na inilabas ni Duterte ang Proclamation 572 noong August 31,2018 at idineklara na walang bisa ang amnestiya na ipinagkaloob kay Trillanes dahil hindi ito umano nakatugon sa minimum requirement para mag-qualify sa Amnesty Proclamation.
Ayon sa Duterte administration, hindi naghain si Trillanes ng official amnesty application form. Hindi rin nito inamin ang pagkakasala sa nangyaring Oakwood Mutiny noong 2003 at Manila Peninsula Siege noong 2007.
Gayunman, sinabi ng Korte na may mga ebidensya na magpapatunay na naghain si Trillanes ng amnesty application.
“The Executive’s decision to revoke only Trillanes’ amnesty, notwithstanding the fact that the application forms of all the other amnesty grantees could similarly no longer be located, constituted a breach of his right to the equal protection of the laws.”
Iginiit ng SC na ang Constitution ang mananatiling angkla o batayan sa pagbalanse sa ‘presidential prerogatives’ at ang proteksyon ng karapatan ng bawat mamamayan. Teresa Tavares
