MANILA, Philippines – Kinuwestiyon ng mga abogado ni Senator Ronald ‘Bato’ dela Rosa ang direktiba ng Department of Justice (DOJ) kaugnay sa pag-aresto sa senador kaugnay ng warrant mula sa International Criminal Court (ICC).
Ayon kina Israelito Torreon at Jimmy Bondoc, dapat munang dumaan sa proseso ng lokal na hukuman ang ICC arrest warrant bago ito maipatupad.
“We have to respect our Constitution. We have to respect customary international law. We have to respect treaty law in this regard,” ani Torreon.
“In the spirit of fair play and due process, and even humanitarianism, hindi po nila pwede i-effect ang isang inactionable na warrant through misrepresentations,” dagdag naman ni Bondoc.
Kinuwestiyon din ng kampo ni Dela Rosa ang umano’y pabago-bagong pahayag ng gobyerno hinggil sa posibleng pag-aresto sa senador.
“Prior to the order rendered by the Supreme Court, they were saying to the public or he was saying to the public that there can be no arrest, on the part of the government, of Senator Bato,” sabi ni Torreon.
Tinukoy nito ang naging desisyon ng Korte Suprema na ibasura ang petisyon ni Dela Rosa para sa temporary restraining order laban sa posibleng pag-aresto ng ICC.
Iginiit naman ni Bondoc na tila determinado umano ang administrasyon na arestuhin ang senador.
“By the sheer act of the President’s arm, by hook or by crook, gusto nilang kunin si Bato. And this simply looks like a Duterte 2.0 move. It is my personal and earnest opinion that this is political, no matter how they frame it,” ani Bondoc.
Sinabi rin ng mga abogado na hindi umano umiiwas si Dela Rosa sa pananagutan at maaari namang magsampa ng kaso sa loob ng bansa.
“Proper cases can be filed in our country because we have a healthy prosecutorial system. We have a healthy judiciary,” dagdag ni Torreon.
Tiniyak naman ng kampo ng senador na gagamitin nila ang lahat ng legal na remedyo para ipagtanggol ito. RNT
