MANILA, Philippines – Inatasan ng Court of Appeals ang Department of Agrarian Reform at Land Bank of the Philippines na bayaran ang Hacienda Luisita ng P28.488 billion bilang kompensasyon sa 4,500 ektarya ng lupa na sakop ng agrarian reform sa Tarlac.
Sa desisyon ng CA Special 12th Division, kinatigan nito ang petition for review na inihain ng kumpanya ng Hacienda Luisita na pag-aari ng pamilya Cojuangco.
Sakop ng petition for review ang mga lupain sa Tarlac City, La Paz at Concepcion.
“Respondents are ordered to pay petitioner the total amount of Php28,488,944,278.71 as just compensation as of 30 April 2025, without prejudice to the accrual of interest until fully paid,” naksaad sa desisyon.
Napatunayan ng appellate court na nagkamali ang Tarlac City Regional Trial Court nang maglabas ito ng resolusyon na nagdismiss sa petition for judicial determination para sa just compensation na inihain ng Hacienda Luisita.
Sa desisyon ng Tarlac RTC, sinang-ayunan nito ang desisyon ng Department of Agrarian Reform Adjudication Board sa valuations na itinakda ng Land Bank at ibinasura ang hirit ng Hacienda Luisita para sa dagdag kompensasyon at interes.
Itinakda ng Land Bank ang valuation sa P304.033 million plus interes na P167.468 million mula 1989 hanggang 1999.
Sa ruling ng CA, hindi tama ang ginawang assessment sa pagbabayad sa Hacienda Luisita.
“Bearing in mind that ultimately, just compensation is about a fair and full equivalent for the loss sustained by the landowner, reliable and actual data should have been considered, with consideration to the pertinent DAR regulations applicable in the instant case,” dagdag ng korte.
