MANILA, Philippines – Handa na ang House prosecution panel na isailalim sa cross-examination si Vice President Sara Duterte sakaling magdesisyon itong tumestigo sa kanyang impeachment trial sa Senado, ayon kay House prosecutor at Akbayan Party-list Rep. Jose Manuel Diokno.
Sa isang press briefing, sinabi ni Diokno na nasa kamay ni Duterte at ng kanyang defense team ang pinal na desisyon kung tatayo ito sa witness stand.
“That’s entirely the call of her defense panel. But we are ready to cross-examine her if she comes out and testifies,” pahayag ni Diokno.
Para sa mambabatas, malaki ang maitutulong sa impeachment court kung personal na maririnig mula kay Duterte ang pagpapaliwanag sa mga kontrobersiyang kinahaharap nito.
“Nasa sa kanya po ‘yan. That’s the call of her lawyers and herself,” giit ni Diokno nang tanungin kung dapat bang humarap ang Bise Presidente upang sagutin ang mga akusasyon pangunahin na ang naging pagbanta sa buhay nina Pangulong Ferdinand Marcos Jr., First Lady Liza Araneta-Marcos, at dating Speaker Martin Romualdez.
“I think that for the court to have a full appreciation of what she is claiming, then the court, I think, would benefit from hearing her explain personally why she said those things that we all saw.”
Ipinaalala rin ni Diokno na paulit-ulit na inimbita si Duterte sa mga nakaraang pagdinig ng House Committee on Justice para sa mga impeachment complaint, ngunit hindi ito sumisipot.
Samantala, ipinaliwanag naman ni private prosecutor Benjamin Tolosa Jr. na malinaw na isinasaad sa Senate Rules of Procedure on Impeachment Trials na obligasyon ng respondent ang magsumite ng sagot at humarap sa korte.
“And just to clarify, under the rules, it’s expressly stated there that the impeachment court shall require the respondent to both file an answer and appear in court,” paliwanag ni Tolosa.
Gayunpaman, binigyang-diin ni Tolosa na bagamat nagsumite na ng opisyal na sagot ang Bise Presidente, wala pang inilalabas na kautusan ang impeachment court para sa personal nitong pagharap.
“So far, in the issuances of the impeachment court, that second part, requiring her to appear, has not been done. So we will wait for the impeachment court when it will find it appropriate to require her to do so,” dagdag nito.
Maliban sa pagbabanta sa buhay ng Pangulo, nahaharap din si Duterte sa mga alegasyon ng maling paggamit ng confidential funds, panunuhol sa mga tauhan ng Department of Education (DepEd), at pagkakaroon ng unexplained wealth.
