MANILA, Philippines — Aapela ang kampo ni Senator Ronald “Bato” dela Rosa sa Philippine National Police (PNP) matapos ang desisyon nitong bawiin ang kanyang firearms license, ayon sa kanyang abogado nitong Huwebes.
Sinabi ni Atty. Israelito Torreon na maghahain sila ng motion for reconsideration sa PNP Firearms and Explosives Office (PNP-FEO) at iginiit na kailangan muna ng conviction o court order bago ma-revoke ang lisensya ng baril ng senador, batay sa Section 39 ng Republic Act No. 10591 o Comprehensive Firearms and Ammunition Regulation Act.
“We will file a most respectful motion for reconsideration with the PNP’s Firearms and Explosives Office (PNP-FEO). And we will try to explain that under Section 39, (of RA No. 10591), which is the actual grounds for the revocation of licenses, only Section 39 B stated the need of a conviction. Section 39J, on the other hand, cited the need for a court order,” ani Torreon sa panayam sa isang ulat.
“(But) Sen. Dela Rosa is not convicted in the Philippines. No Philippine court has also issued any order against him,” dagdag niya.
Kinuwestiyon din ng abogado ang posisyon ng National Bureau of Investigation (NBI) na kinikilala ang International Criminal Court (ICC) bilang korte sa ilalim ng doctrine of incorporation.
“And the NBI’s answer that the ICC is a court of law under the doctrine of incorporation, to us that is erroneous,” ani Torreon.
Paliwanag pa niya, ang doctrine of incorporation sa ilalim ng 1987 Constitution ay hindi nangangahulugang bahagi ng Philippine courts ang mga foreign tribunal.
“The ICC was not established based on Philippine laws, and the orders of the ICC cannot be reviewed by our Supreme Court. Their judges are not appointed under our Constitution. It is not a court of law under the contemplation of RA 10591,” dagdag niya.
“So we think there is something wrong with the PNP’s decision, and we will file a most respectful motion for reconsideration, a motion with utmost respect,” aniya.
Nauna nang kinumpirma ng PNP na binawi na nito ang firearms licenses ni Dela Rosa, na nahaharap din sa arrest warrant mula sa ICC.
Ayon sa PNP-FEO, may batayan ang hakbang dahil sa umano’y pending criminal case na may parusang higit dalawang taon, dahilan para irekomenda ang revocation ng lisensya ng senador.
Iniutos din ng FEO ang pagkumpiska o pagdeposito ng 117 baril na nakarehistro sa pangalan ng senador para sa tamang disposisyon ayon sa batas.
Kaugnay nito, nagpapatuloy ang manhunt laban kay Dela Rosa matapos umano siyang makalabas sa Senado noong Mayo 14 kasunod ng insidente ng pamamaril sa loob ng gusali.
Tinawag naman ng NBI si Dela Rosa na “armed and dangerous,” at sinabing dapat siyang lapitan nang may pag-iingat habang isinasagawa ang operasyon.
