MANILA, Philippines – Ibinasura ng Department of Justice (DOJ) ang isinampang reklamo ni dating Pangulong Rodrigo Duterte laban kina Interior Secretary Benhur Abalos at Philippine National Police chief Gen. Rommel Marbil kaugnay sa pagsisilbi ng arrest warrant laban kay Pastor Apollo Quiboloy sa Davao City.
Sa 13-pahinang resolusyon ni Assistant State Prosecutor Angelica Laygo-Francisco, dinismis ang reklamong malicious mischief at violation of domicile laban kina Abalos, Marbil, at iba pang opisyal ng PNP dahil sa paninira sa gate ng Kingdom of Jesus Christ (KOJC) compound sa Barangay Buhangin at sa Prayer and Glory Mountains sa Barangay Tamayong.
Kabilang din sa inireklamo sina Brig. Gen. Aligre Martinez, Maj. Gen. Ronald Oliver Lee, Col. Edwin Portento, Col. Joselito Clarito, Lt. Col. Lino Akiangan, Maj. Gen. Mark Pespes, at Brig. Gen. Ricardo Layug.
Sinabi ng DOJ na walang sapat na batayan ang inihain na reklamo. Wala ring naipakitang pruweba ang complainant para mapanagot sa kaso ang mga respondent. Napatunayan na tatlo sa mga inireklamo ay wala naman sa lugar na sinalakay.
“The law requires evidence of individual culpability, of specific, intentional acts that constitute the offense. The present complaints offer none,” nakasaad sa resolusyon.
Malayo rin sa katotohanan ang mga ibinintang dahil ginagawa lamang ng mga respondent ang tungkulin nilang ipatupad ang batas.
“Their actions, as alleged, fall within the realm of lawful performance of duty and are protected by the presumption of regularity in official functions,” ayon sa DOJ. Teresa Tavares
