MANILA, Philippines — Nilinaw ng Senate impeachment court nitong Martes na AI-generated ang mga kumakalat sa social media na larawan umano ni hostile witness Lemuel Ortonio na may suot na earpiece.
Ayon kay Senate impeachment court presiding officer Francis “Chiz” Escudero, mali ang mga larawang nagpapakitang mayroong earpiece si Ortonio.
“Hindi totoo ‘yung lumalabas na mga letrato na hindi umano mayroong earpiece si Mr. Ortonio. ‘Yun po ay AI,” ani Escudero sa pagsisimula ng Day 20 ng impeachment trial ni Vice President Sara Duterte.
Dagdag niya, ang nakita sa tainga ni Ortonio ay ear piercing sa front fold helix, at hindi earpiece.
Si Ortonio, Assistant Secretary at Assistant Chief of Staff ng Office of the Vice President (OVP), ay tumestigo noong nakaraang linggo hinggil sa umano’y maling paggamit ng confidential funds ni Duterte.
Binigyang-diin naman ni Escudero na lahat ng testigo ay dapat magsalita batay lamang sa kanilang sariling kaalaman at walang coaching o impluwensya mula sa abogado o ibang tao.
Dahil dito, ipinagbawal ni Senate Impeachment Court Presiding Officer Francis “Chiz” Escudero ang paggamit ng anumang klase ng listening devices at gadgets para sa mga tatayo bilang testigo sa impeachment trial.
Bago simulan ang Day 20 ng pagdinig, nilinaw ng Presiding Officer na walang ginamit na anumang ilegal na kagamitan si Ortonio.
“After Mr. Ortonio testified before this court, an image of him allegedly wearing an earpiece was widely circulated on the internet. Hindi earpiece kundi isang uri ng ear piercing ang nasa tainga ng saksi. We take this opportunity after verification that it was an AI-generated image and simply false”paliwanag ni Escudero.
Bagaman napatunayang gawa-gawa lamang ang kumalat na larawan, ginamit ito ng impeachment court upang maglatag ng mas mahigpit na alituntunin laban sa coaching o pagbibigay ng tulong sa sinumang tetestigo.
“Every witness must testify solely from his or her own knowledge, free from coaching or influence from counsel or any other person,” ani Escudero.
Ibinase ni Escudero ang kautusan sa Section 21(e) ng Supreme Court A.M. No. 24-11-02-SC, maging sa mga legal precedent gaya ng Villarreal v. Texas ng US Supreme Court at ang 2010 Florida case na Sky Development Inc. v. Vistaview Development Inc. na parehong nagpaparusa sa pag-impluwensya sa saksi habang nagbibigay ng testimonya, dahil dito ipinagbabawal ang ang paggamit ng earpiece, headset, cell phone, smartwatch, smart glasses o anumang device na may kakayahan na magtransmit o tumanggap ng komunikasyon.
“Witnesses are also prohibited from receiving or attempting to receive any communication, suggestion, answer, signal, message, or prompt from any person, whether inside or outside this court, regardless of the means employed.” nakasaad sa kautusan, habang ang medical, accessibility, o interpretation devices naman ay maaari lamang gamitin kung may pahintulot ng impeachment court.
Mananatili ang nasabing pagbabawal kahit nakarecess ang trial at magtatapos lamang kapag pormal nang idineklara ng korte na discharged na ang saksi. RNT/MDS/Gail Mendoza
