MANILA, Philippines – Kinastigo ni lead defense lawyer Sheila Sison nitong Miyerkules, Agosto 12 si private prosecutor Amando Ligutan sa Senate impeachment court sa kanyang pahayag na inilabas sa personal na social media page na tila tumutukoy sa isa sa mga counsel ng depensa.
Bago nito ay nagkaroon ng sagutan sa pagitan nina defense counsel Kristine Ferrer at Lorna Kapunan ng prosecution panel sa cross-examination ni state auditor Xylene Mae Del Campo sa paggamit ng confidential funds ni Vice President Sara Duterte.
Pinuna kasi ni Kapunan ang pagsasagawa ni Ferrer ng cross examination.
“Misleading questions are not allowed on cross,” sinabi ni Kapunan.
“They are allowed,” tugon naman ni Ferrer.
Sa kanyang Facebook post 11:29 ng umaga, sinabi ni Ligutan na:
“A principle ALL lawyers and law students know by heart: Misleading questions are NOT allowed even on cross-examination.”
Sa manipestasyon sa pagtatapos ng impeachment trial, nilinaw ni Sison na si Ferrer ay “only saying that leading questions are allowed on cross-examination, not misleading questions.”
“And yet we have a private prosecutor immediately taking to social media and posting this, implying something against the defense counsel. We will not have this,” dagdag pa niya.
“It is inappropriate to do that to a fellow member of the bar because even as we sit on the opposing side of this hall, we remain to be both members of the bar. And as officers of the court, we owe each other respect,” pagpapatuloy ni Sison.
Ani Sison, “troubling” at “in bad taste” ang paglalabas ni Ligutan ng ganitong pahayag “in the middle of a courtroom hearing,” at sinabing pinagbabawalan ang mga abogado na magkomento sa merito ng kaso.
Hindi naman pinayagan ni trial presiding officer Francis Escudero na sumagot si Ligutan sa manipestasyon ni Sison ngunit sinigurong magkakaroon ito ng oportunidad bago mag-rule ang senator judge sa isyu sa susunod na linggo.
Sa panayam matapos mag-adjourn ang paglilitis, iginiit ni Ligutan na wala siyang binanggit na sinuman sa kanyang post at sinabing, “If they felt alluded to, sa kanila na po iyon.”
“Buburahin ko ba? Hindi allowed ang misleading questions. Hindi ko ‘yan buburahin dahil ‘yun ang nakasaad sa ating Rules of Court. Buti sana kung I named somebody na this is regarding this,” dagdag pa niya. RNT/JGC
