MANILA, Philippines- Inihirit ng regional TV station na mag-inhibit ang regulators sa administrative complaint laban sa umano’y franchise violations ng network.
Naghain ng mosyon ang Sonshine Media Network International (SMNI), sa pamamagitan nina legal counsel Mark Tolentino at Rolex Suplico, na humihikayat sa National Telecommunications Commission (NTC) officials – Commissioner Ella Lopez at Deputy Commissioners Jon Salvahan and Alvin Blanco – na huwag nang makibahagi sa administrative case at mag-inhibit sa basehan ng “unfair bias.”
“The three sitting commissioners, with all due respect, should be disqualified from hearing and rendering a judgment in this administrative case as it is also the complainant itself,” pahayag ng SMNI sa mosyong inihain sa komisyon nitong Huwebes ng umaga.
“The NTC is the judge, the NTC is the complainant, the NTC is the executioner. We cannot expect justice from the NTC,” pahayag ni Suplico sa isang panayam nitong Huwebes.
Lumagda sina Lopez, Salvahan, at Blanco sashow cause order na may 30-day suspension laban sa SMNI noong Disyembre.
Kasunod ito ng House resolution na nagtutulak ng suspensyon ng SMNI dahil sa umano’y paglabag sa terms and conditions ng prangkisa nito.
Ani Tolentino, maaaring idulog ang kaso sa Department of Justice.
Binanggit din ng SMNI na naghain ito ng petition for review sa Court of Appeals na humahamon sa NTC suspension order.
“Judicial courtesy dictates that it stops any action on this case until such time the honorable Court of Appeals has rendered a decision in the petition filed,” anang SMNI.
Isinagawa ng NTC ang unang pagdinig nito sa kaso nitong Huwebes ng umaga. Inihayag ni Suplico na binigyan nito ang network ng 10 pang araw hanggang Jan. 15 para tumugon. RNT/SA
