MANILA, Philippines – Dapat bayaran ng Solar Philippines Power Holdings Inc., na itinatag ni Batangas Representative Leandro Leviste, ang humigit-kumulang PHP24 bilyong multa sa Department of Energy (DOE) bago matapos ang Pebrero, ayon kay Energy Secretary Sharon Garin.
Ibinahagi ito ni Garin sa mga mamamahayag noong Biyernes sa sidelines ng Renewable Energy Investment Forum sa Taguig City, at sinabing dapat bayaran ang multa isang buwan matapos ipadala ang demand letter.
“I think it’s one month after the demand letter [was sent]… It was sent about weeks ago, so it should be settled within this month,” ani Garin.
Noong nakaraang buwan, nagpataw ang DOE ng halos PHP24 bilyong parusa matapos kanselahin ang mga renewable energy contract ng kumpanya dahil umano sa kabiguang tuparin ang mga production commitment nito.
Saklaw ng mga multa ang performance bonds, mga obligasyong kontraktuwal, halaga ng proyekto, at iba pang obligasyong pinansiyal, kabilang ang para sa training at development fund. Nag-ugat ito sa umano’y kabiguang maihatid ang halos 12 gigawatts na renewable energy capacity.
“As far as the DOE is concerned, this is final already… so if they [Solar Philippines] don’t pay, then we take it to the legal recourse that we have,” ani Garin.
Dagdag niya, hinihintay ng DOE ang rekomendasyon ng Department of Justice, Office of the Ombudsman, at Office of the Solicitor General kaugnay ng posibleng hakbang kung hindi magbabayad ang kumpanya.
“I will trust the decision of those agencies on what the options are for the DOE or the national government on what to do if they don’t pay,” aniya.
Nauna ring sinabi ni Garin na paulit-ulit nang nagpadala ang DOE ng mga abiso, show cause order, at kahilingan para sa renewal ng performance bond, ngunit walang tugon mula sa kumpanya.
“We have not received any response from the (their) company nila sa DOE, dun sa performance bond nila na kailangan nilang bayaran,” ani Garin. Dave Baluyot
