THE HAGUE, Netherlands – Hiniling ng kampo ni dating Pangulo Rodrigo Duterte sa administrasyon ni Marcos na payagan itong umuwi ng Pilipinas kung ang hiling nito na interim release ay mapagbigyan ng ICC.
Ito ay matapos na ibunyag ni Atty. Nicholas Kaufman, na ang kalagayan ni Duterte na “progressively deteriorating medical situation” ay nakaka-apekto sa kanyang abilidad na i-assimilate ang ebidensya at magbigay ng mga tagubilin.
“The defense sincerely hopes that the current administration, which [saw] fit to outsource its obligation to afford the former president a fair trial in the country of his birth, will now let him return home, with dignity, for the purpose of interim release until the end of all legal proceedings,” saad ni Kaufman.
Si Duterte, 80-anyos, ay nasa kustodiya ng ICC mula noong Marso. Noong Agosto, inulit niya ang kanyang kahilingan sa ICC para sa pansamantalang pagpapalaya sa isang hindi nasabi na bansa “subject to any conditions deemed appropriate.”
Nitong Lunes, inihayag ng international tribunal na ang confirmation of charges hearing para sa kasong crimes against humanity ni Duterte ay ipinagpaliban matapos sabihin ng kampo nito na siya ay “not fit to stand trial.”
Ang pagdinig ay unang itinakda sa Setyembre 23.
Inilabas ni Kaufman ang pahayag nang tanungin tungkol sa kalagayan ni Duterte at kung ano ang hindi karapat-dapat na humarap sa paglilitis.
“Out of respect for the former president’s legacy, the defense would not raise such a plea were it not supported by leading medical experts, including one not selected by the defense,” aniya.
“All litigants—the prosecution, the defense, and the Office of the Public Counsel for Victims—agree that the matter requires judicial determination, and for anyone to suggest otherwise would be a malicious insult to all those involved and affected,” dagdag niya.
Samantala, ang mga pamilya ng umano’y biktima ng drug war ay nagpahayag ng pagkadismaya sa pagpapaliban. Sinabi nila na maaaring talikuran ni Duterte ang kanyang karapatan na dumalo sa pagdinig at magtalaga ng isang abogado na kumatawan sa kanya. RNT/MND
