MANILA, Philippines- Ipinag-utos ng isang korte sa Pasay sa Bureau of Jail Management and Penology (BJMP) na pakawalan ang aktres at negosyanteng si Neri Naig-Miranda.
“The BJMP received the court order issued today by RTC (Regional Trial Court Branch) 112 ordering the release of Nerizza Miranda,” pahayag ni BJMP spokesperson Jail Supt. Jayrex Bustinera.
Inaresto si Naig-Miranda dahil sa umano’y syndicated estafa at paglabag sa Securities Regulation Code sa basement ng isang convention center sa loob ng Pasay City mall nitong Sabado.
Sa utos ng Pasay RTC, pinawalang-bisa nito ang arrest warrant na inisyu laban kay Naig-Miranda sa kanyang syndicated estafa case, dahil umano sa “procedural defect in the service of process.”
“While a subpoena was issued by the OCP (Office of the City Prosecutor) Pasay City to notify accused Miranda of the charges leveled against her, it appears that the said subpoena was sent to… Batangas City instead of the correct address of the accused located at… Cavite,” anang korte.
Ayon sa korte, kahit ito ay isang “honest mistake,” hindi pa rin umano wastong naipagbigay-alam kay Naig-Miranda ang proceedings.
Anang korte, ito ay pagtanggal sa kanyang right to due process.
“[T]he lack of proper notice to accused Miranda in flagrant violation of her constitutional right to due process of law invalidates the preliminary investigation conducted by the OCP-Pasay City as well as the subsequent acts or proceedings emanating therefrom,” pahayag nito.
Inatasan din nito ang Pasay City Prosecutor’s Office na magsagawa ng panibagong preliminary probe.
Samantala, ibinasura nito ang motion to withdraw the information o kaso laban kay Naig-Miranda.
Kasalukuyang nasa hindi tinukoy na ospital ang aktres para sa medical evaluation.
Batay sa ulat, hindi na ibabalik si Naig-Miranda sa Pasay City Jail female dormitory.
Noong Nobyembre, inihirit ng kampo ni Naig-Miranda na ibasura ang kaso laban sa kanya.
Dahil dito, ang arraignment para sa umano’y paglabag niya sa Securities Regulation Code ay inilipat sa Enero 9, 2025.
Kasado naman ang arraignment ni Naig-Miranda para sa syndicated estafa ng Disyembre 3, subalit ipinagpaliban dahil hinihintay pa ng korte ang komento mula sa prosecutor. RNT/SA
