PCGG: 16 ill-gotten vehicles nabawi ng gobyerno

MANILA, Philippines- Sinabi ng Presidential Commission on Good Government (PCGG) na nabawi ng gobyerno ang ill-gotten wealth na P5 milyong halaga ng motor vehicles.

Ang PCGG, ahensya ng gobyerno na naatasan na habulin ang ill-gotten wealth ni dating Pangulong Ferdinand Marcos Sr., miyembro ng kanyang pamilya at mga kasama, ay nagpalabas ng kalatas matapos na mag-isyu ang Sandiganbayan ng desisyon na nagbabasura sa ill-gotten wealth case sa ilalim ng Civil Case 0032 na isinampa laban kay dating Pangulong Marcos at kanyang asawa na si dating Unang Ginang Imelda, dahil sa kawalan ng aksyon ng mga government prosecutor.

Sa Civil Case 0032, isinampa ng gobyerno laban sa Marcos couple at dating Malacañang photographer na si Fernando Timbol noong July 1987, ay sangkot ang 16 umano’y ilegal na nakuhang motor vehicles at household appliances na dapat na ibalik sa pamahalaan.

“The Supreme Court Decision dated February 8, 1989 declared the properties acquired by defendant Timbol as ill-gotten, and forfeited in favor of the Republic. A writ of execution was then issued, transferring the custody of the said vehicles to the PCGG,” ang sinabi ng PCGG.

“By virtue of the writ of execution, the PCGG was able to successfully recover the 16 forfeited motor vehicles,” dagdag na pahayag nito.

Ang kalatas ng PCGG ay hindi naman eksaktong sumasalamin sa naging desisyon ng Sandiganbayan hinggil sa Civil Case 0032 na may petsang February 18.

Nakasaad sa February 18 decision ng Sandiganbayan na ang writ of execution ay naipalabas at ang kustodiya ng mga nasabing behikulo ay dapat na inilipat sa PCGG bilang sumasalamin sa Sheriff’s Progress Report na may petsang March 31, 1989 at Sheriff’s Return na may petsang January 8, 1990.

Gayunman, ang kaparehong anti-graft court decision ay nagsasaad din na “the writ of execution on the subject household appliances was left unsatisfied considering that said appliances can no longer be identified by the one who made the inventory thereof.”

Ang PCGG, sa naging kalatas nito matapos na ipalabas ng Sandiganbayan ang February 18 decision nito, ay nagpahayag na ang proceedings ay nananatiling nakabinbin sa Sandiganbayan hanggang itinakda ng anti-graft court ang case conference noong January 21 ng taong kasalukuyan upang isara ang kaso.

“During the said conference, the PCGG manifested that it has no objection if the court will consider the case closed and terminated considering that the Commission has satisfied the writ of execution with the successful turnover of the properties sought to be recovered,” base sa PCGG.

“Given this, the Office of the Solicitor General (OSG) was also amenable to the closure and termination of the case. In light of PCGG’s manifestation, the Sandiganbayan dismissed the case against the Marcos spouses,” dagdag na pahayag ng PCGG. Kris Jose
