MANILA, Philippines – Naghain si Senador Imee Marcos ng panukala na layong ipagbawal ang pag-aresto at pag-detain sa sinumang indibidwal sa teritoryo ng Pilipinas at ilipat ang mga ito sa isang international court nang walang warrant of arrest na inisyu ng lokal na korte.
Sa explanatory note ng Senate Bill No. 557, o kilala bilang President Rodrigo R. Duterte Act, tinawag ni Marcos ang pag-aresto at pagturn-over sa dating Presidente sa International Criminal Court bilang “abuses by the authorities” na maaaring mangyari kahit kanino.
“What took place on that fateful day was an extraordinary rendition—the transfer without due process of a detainee to the custody of a foreign jurisdiction,” anang Senador.
“Thus, it is necessary to make it exceedingly clear—if it is not yet clear already—that arresting an individual for the purpose of turning him or her over to a foreign jurisdiction without an order and a warrant of arrest issued by a Philippine court is against the Constitution and punishable under the law,” dagdag pa niya.
Ang mga ipinagbabawal sa ilalim ng panukalang batas ay ang paglilipat sa isang tao o Filipino sa teritoryo ng Pilipinas patungo sa isang international court, tribunal, organization, o State kung saan ang hurisdiksyon o authority na mag-imbestiga, magparusa, mag-detain mag-bilanggo o mag-execute ng isang tao ay hindi kinikilala ng Pilipinas sa pamamagitan ng isang treaty o international agreement; o walang kaukulang written at voluntary consent ng isang tao sa paglilipat o kautusan na inisyu ng isang korte sa bansa na magpapayag ng paglilipat.
Layon din ng panukala na ipagbawal ang pag-aresto o pag-detain, o pag-aresto at detention ng sinuman sa Pilipinas para ilipat ang mga ito sa international court, tribunal, organization, o State nang walang arrest warrant na inisyu ng korte sa Pilipinas.
Ipagbabawal din ang pag-imbestiga, pag-aresto, pag-detain o pagparusa “of any local on behalf of, in favor of, or upon the orders of any international court or the like;” nang walang kaukulang permit na inisyu ng Department of Justice (DOJ) at Department of the Interior and Local Government (DILG).
“The Department of Foreign Affairs shall exhaust every diplomatic channel to ensure that Filipino citizens who are victims of extraordinary rendition will be repatriated to the Philippines as soon as possible and that judgments of the Philippine court will be given effect,” saad pa sa panukala.
Si Duterte ay inaresto sa Pilipinas ng mga awtoridad noong Marso 11, batay sa warrant of arrest na inisyu ng ICC.
