MANILA, Philippines – “Not optional” ang impeachment trial ni Vice President Sara Duterte ayon sa isang miyembro ng House prosecution team.
Noong Hunyo 25, sinabi ni Senate President Francis “Chiz” Escudero, na maaaring i dismiss ang kaso laban kay Duterte kung magkaroon ng mosyon at ipasa ng majority, o makabuo ng 13 na boto.
Gayunpaman, ayon kay Bukidnon Rep. Jonathan Keith Flores, miyembro ng House prosecution team, “It [trial] is not optional. As soon as it is filed, as I understand it, it is the Senate’s obligation to hear and decide the case.”
Nagpulong ang Senado bilang impeachment court noong Hunyo 10 at ibinalik sa Kamara ang articles of impeachment para i-verify na hindi ito lumalabag sa “one-year bar rule” at balak pa rin ng 20th Congress na ituloy ang kaso.
Pinagtibay naman ng Kamara, makalipas ang isang araw, ang isang resolusyon na nagpapatunay na ang impeachment complaint laban kay Duterte ay sumunod sa Article XI, Section 3, Paragraph 5 ng 1987 Constitution, na tumutugon sa unang requirement.
Nakasaad sa probisyon ng konstitusyon: “No impeachment proceedings shall be initiated against the same official more than once within a period of one year.”
Ngunit batay sa pangalawang requirement, ayon kay Flores, “No certification or compliance can be done until the 20th Congress is organized and starts.”
Nakatakdang pormal na buksan ng 20th Congress ang sesyon nito sa Hulyo 28, simula sa ikaapat na State of the Nation Address ni Pangulong Ferdinand Marcos Jr.
Noong nakaraang Sabado, sinabi ni House prosecution panel spokesperson Antonio Bucoy na kung ibasura ng Senado ang impeachment complaint nang walang paglilitis, maaaring maghain ang kanilang team ng petition for certiorari with mandamus sa Korte Suprema. RNT/MND
