Prosecution, Defense team ni VP Sara, nagbanggaan sa ‘accused’ sa impeachment court

MANILA, Philippines – Bago pa ang inaabangang debate sa conviction threshold, nagkainitan na ang magkabilang panig sa impeachment trial ni Vice President Sara Duterte nitong Miyerkules dahil sa paggamit ng salitang “accused” sa pagtukoy kay Duterte sa paglilitis.

Nagsimula ang argumento matapos humingi ng paglilinaw si House prosecutor Chel Diokno sa Senate impeachment court kung paano dapat tawagin si Duterte, matapos mapansin na tinawag siya noon ng depensa bilang “accused” sa halip na “respondent.”

“And we all know this is not a criminal proceeding, this is a sui generis proceeding, and of course we do not want to condition the mind of anyone that this case is criminal in nature,” ani Diokno.

Tumugon naman si Senate President Francis Escudero na tulad ng mga naging ruling ng mga nakaraang impeachment court, ang respondent ay tinatawag lamang na “the respondent.”

“That’s why the chair also refers to the opposing side as counsel for respondents,” ani Escudero na tumutukoy sa depensa.

Dahil dito, hiniling ni Diokno na burahin sa records o opisyal na transcript ng korte ang salitang “accused.”

Ngunit itinanggi ni lead defense counsel Sheila Sison na tinawag lamang nilang “accused” ang kanilang kliyente, at sinabing ang talagang ginamit nila ay “respondent-accused.”

“If the prosecution wishes to clarify why the defense refers to the vice president as ‘respondent-accused,’ even though the prosecution feels that this is not a criminal action per se, the articles of impeachment will show that the charges are criminal in nature,” ani Sison.

Iginiit naman ni Diokno na ang narinig niya ay “accused” lamang, at inulit ang kanyang mosyon na burahin ito. Tinutulan din niya ang paliwanag ni Sison, at sinabing ang impeachment trial ay hindi criminal case “by any stretch” dahil walang criminal liability na sangkot sa kaso at umiikot lamang ito sa fitness ni Duterte na manatili sa puwesto.

“Therefore, it would be improper and it may even lead to misconceptions if the respondent’s counsel were to refer to the vice president as the accused,” dagdag niya.

Iginiit naman ni Sison na kung misconception ang pinag-uusapan, “no greater danger than a misconception in the idea that the constitutional presumption of innocence” ang hindi i-apply sa impeachment case.

Kinilala naman ni Diokno na bagama’t ang Bill of Rights ay naa-apply sa lahat ng uri ng paglilitis, ang presumption of innocence — sa konteksto ng proof beyond reasonable doubt — ay naa-apply lamang sa criminal proceedings.

Ngunit mariin pa ring tinutulan ito ni Sison at sinabing ang presumption of innocence ay “not debatable” at mapanganib kung ipahihiwatig sa publiko at sa mga iskolar ng batas na hindi ito naa-apply.

Kalaunan ay nagdesisyon si Escudero pabor sa depensa, matapos banggitin ang transcripts ng korte na nagpakita na tinawag nga ng depensa si Duterte bilang “respondent-accused.” Binanggit din niya ang isang 1922 case, “In re Impeachment of Horrilleno,” na tumukoy sa impeachment process bilang “criminal in nature.”

“Chair therefore rules against the motion of honorable Diokno, member of the panel of prosecutors, and will not delete the referral of the counsel for the respondent to the respondent as ‘respondent-accused’,” ani Escudero.  Ernie Reyes
