MANILA, Philippines- Mayroong regulatory authority ang Food and Drug Administration (FDA) sa tobacco products pagdating sa aspeto ng pangkalusugan.
Ito ang idineklara ng Supreme Court En Banc kasabay ng pagbasura sa motions for reconsideration na inihain ng Philippine Tobacco Institute, Inc. (PTI) at Albay Representative Edcel C. Lagman.
Ipinaalala ng SC na sa ilalim ng Republic Act No. 9711 o ang Food and Drug Administration Act (FDA Act), ang FDA ay mayroong regulatory authority sa lahat ng produktong may kinalaman sa kalusugan ng tao.
Nakasaad sa implementing rules ng batas na ang Department of Health ang responsable para sa pag-regulate ng tobacco products sa pamamagitan ng FDA.
Kinuwestiyon ng PTI ang nabanggit na probisyon sa implementing rules at sinabi na ang Inter-Agency Committee Tobacco (IAC-Tobacco) ang may natatanging hurisdiksyon sa tobacco products kahit ang health aspect nito.
Gayunman, iginiit ng SC na ang IAC-Tobacco ay walang esklusibong hurisdiksyon sa mga tobacco product at sa mismong industriya ng tobacco.
“All products affecting health, including tobacco products, are covered by the FDA’s mandate to ensure the safety, efficacy, purity, and quality of health products,” nakasaad sa desisyon.
