THE HAGUE – Inireklamo ng tatlong judge ng International Criminal Court (ICC) nitong Miyerkules, Hunyo 24, si U.S. President Donald Trump at administrasyon nito sa mga sanction na ipinataw sa kanila noong nakaraang taon.
Ang lawsuit ay inihain sa federal court sa Manhattan, kung saan sinabi nina judge Kimberly Prost ng Canada, Solomy Balungi Bossa ng Uganda at Reine Adelaide Sophie Alapini-Gansou ng Benin na ang mga sacntion ay nakadisenyo upang ipakita ang extrajudicial pressure sa layuning parusahan at gipitin ang mga judge.
Wala pang tugon ang State and Treasury departments at ang White House kaugnay nito.
Matatandaan na nagpataw ng sanctions ang Trump administration sa ilang judge sa International Criminal Court noong nakaraang taon bilang ganti sa pag-iisyu ng war tribunal ng arrest warrant para kay Israeli Prime Minister Benjamin Netanyahu at ang desisyon na buksan ang kaso ng umano’y war crimes ng mga tropang Amerikano sa Afghanistan.
Samantala, iginiit naman ng lawsuit na ang mga sanction ay labag sa batas dahil lampas na ito sa sakop ng International Emergency Economic Powers Act at hindi nakabatay sa tunay na national emergency o extraordinary threat.
“The Sanctions Regime … is designed to exert extra-judicial pressure on these judges and their colleagues on the ICC bench by targeting their financial and other personal interests, with the objective of punishing them for prior judicial decisions and coercing them into prioritizing their private interests over deciding cases on the basis of the law and facts,” saad sa lawsuit.
“Being subjected to such sanctions under IEEPA is tantamount to the financial death penalty. Due to the sanctions, Judges Prost, Bossa, and Alapini-Gansou are no longer able, among other things, to use credit cards; access banking services; use common online platforms, such as Amazon and Google; book travel; and in some cases, obtain health insurance,” dagdag pa.
Sinabi rin ng mga judge na pinipigilan ng mga sanction ang pagpapasa ng ebidensya at argumento sa anumang pending o future proceeding sa kanila. RNT/JGC
