2016 arbitral ruling, iginiit ng Pinas sa UN

MANILA, Philippines – Muling iginiit ng Pilipinas sa United Nations (UN) General Assembly na pinal at may bisa sa mga partido ang 2016 arbitral ruling na nagpasawalang-bisa sa malawak na claim ng China sa South China Sea.

Bilang tugon sa pahayag ng China na hindi tamang forum ang UN para talakayin ang isyu sa South China Sea, iginiit ni Paolo Mapula, Second Secretary at First Committee Expert ng Permanent Mission of the Philippines to the UN, ang karapatan ng Pilipinas sa exclusive economic zone (EEZ).

Ayon kay Mapula, ikasampung anibersaryo ngayong taon ng arbitral ruling at nananatiling pangunahing batayan ng polisiya ng Pilipinas sa South China Sea ang United Nations Convention on the Law of the Sea (UNCLOS) at ang ruling.

“This year marks the tenth anniversary of the Award. The Philippines recalls that UNCLOS and the Award are the twin anchors of our policy and actions in the South China Sea. UNCLOS establishes the legal framework within which all activities in the oceans and seas must be carried out. The Award, rendered by an Arbitral Tribunal constituted under Annex VII of UNCLOS, is final and binding upon the parties pursuant to Article 296 of the Convention and Article 11 of Annex VII.”

Iginiit din ng Pilipinas na ang nine-dash line claims ng China ay “contrary to the Convention” at “exceed the geographic and substantive limits” ng mga karapatang maaaring makuha ng China sa ilalim ng UNCLOS.

Sinabi ni Mapula na pinagtibay rin ng tribunal ang sovereign rights ng Pilipinas sa EEZ nito at nakitang lumabag sa mga karapatang ito ang ilang aksyon doon.

Binanggit din ng Pilipinas ang insidente noong Setyembre 24 kung saan umano’y “interfered” ang China Coast Guard at Chinese militia vessels sa rotation at resupply mission ng BRP Sierra Madre sa Ayungin Shoal, na nasa loob ng EEZ ng Pilipinas.

“Interference with lawful Philippine activities there must therefore be considered against the rights and obligations established by UNCLOS and clarified by the Award,” ani Mapula.

Tinanggihan din ng Pilipinas ang pagtatatag ng China ng nature reserve sa Bajo de Masinloc o Scarborough Shoal, na ayon sa Maynila ay nasa teritoryo nito.

“The Philippines rejects China’s measure and calls for compliance with UNCLOS and the Award,” pahayag ni Mapula.

Nanawagan ang Pilipinas sa China na igalang ang international law at sumunod sa UNCLOS at sa final and binding 2016 South China Sea Arbitral Award.

“The Philippines will continue to exercise its rights and discharge its obligations in accordance with international law. We call on China to do the same and to comply with UNCLOS and the final and binding 2016 South China Sea Arbitral Award,” dagdag niya.

Samantala, tinawag naman ng China na “erroneous claims” ang posisyon ng Pilipinas. Sinabi ni China’s Deputy Permanent Representative to the UN Sun Lei na hindi kinikilala at tinatanggap ng Beijing ang arbitral ruling.

Ayon kay Sun, “the Philippines’ attempt to emphasize the fact that a decade has passed since the so-called award is ‘utterly meaningless.'”

Giit ng China, hindi umano nalutas ng ruling ang maritime disputes nito at ng Pilipinas at sa halip ay nakadagdag sa tensyon sa rehiyon at sa paglala ng relasyon ng dalawang bansa. RNT/MDS
