2016 arbitral ruling kinilala sa ITLOS advisory – DFA

MANILA, Philippines – Malugod na tinanggap ng Pilipinas ang advisory opinion na inilabas ng International Tribunal for the Law of the Sea (ITLOS) na kumilala sa mahahalagang bahagi ng 2016 South China Sea arbitration ruling bilang “authoritative.”

Ang advisory opinion ay tugon sa hiling na ipinasa ng Commission of Small Island States on Climate Change and International Law noong Disyembre 2022.

Lumahok ang Pilipinas sa pagdinig noong Setyembre 2023 bilang suporta sa panawagan ng small island states for protection laban sa epekto ng climate change.

“This bolsters and reinforces the legitimacy of the final and binding 2016 Arbitration Award and its unassailable status as part of the corpus of international law,” saad sa pahayag ng Department of Foreign Affairs.

“The Philippines therefore takes this opportunity to reiterate its continuing call for full compliance with the Award.”

Pinagtibay sa 2016 arbitration ruling ang exclusive economic zone ng Pilipinas laban sa historical claims ng China sa pinag-aagawang South China Sea sa ilalim ng UNCLOS.

Sa kabila nito, hindi naman kinilala ng China ang naturang desisyon.

“The Philippines recognizes that advisory opinions are significant contributions to the clarification and development of international law,” anang DFA.

“The Philippines reiterates that the rule of law ensures equity in the global commons and a fair, just, and peaceful multilateral world order.”

Inimbitahan din nito ang iba pang mga bansa na lumahok sa constructive dialogue at masusing pag-aaral sa ITLOS advisory opinion. RNT/JGC
