MANILA, Philippines – Tinanggihan ng korte sa Maynila ang mosyon ni dating Negros Oriental Representative Arnolfo “Arnie” Teves Jr. na manatiling naka-detain sa kustodiya ng National Bureau of Investigation (NBI) sa New Bilibid Prison.
Sa limang pahinang kautusan, inisyu ng Manila Regional Trial Court (RTC) Branch 51 ang commitment order sa paglilipat kay Teves mula sa NBI patungong Metro Manila District Jail (MMDJ) sa Camp Bagong Diwa, Bicutan, Taguig City.
Ang Branch 51 ang humahawa ng murder, frustrated murder, at attempted murder case ni Teves sa umano’y pagpatay kay Negros Oriental Governor Roel Degamo at 10 iba pa noong 2023.
“This Court finds no merit in the motion of the accused to maintain his custody with the NBI detention facility,” sinabi ng korte.
Sa kanyang mosyon, nagpahayag ng pangamba ang kampo ni Teves sa kaligtasan nito.
Tinukoy din ang Certificate of Handover na pinirmahan ng pamahalaan ng Timor-Leste at Pilipinas bago ang deportation.
Sa kabila nito, sinabi ng RTC na hindi sinasabi sa certificate na may isang tukoy na ahensya ang dapat na magkaroon ng kustodiya kay Teves bilang prerequisite sa kanyang paglilipat.
Hindi rin nito binigyan ng bigat ang pahayag ni Teves na maaari siyang makaranas ng torture, inhuman o degrading statement.
“While the detention facilities in our country may not possess the luxuries a person may have been accustomed to, the detention therein does not automatically make it inhuman or degrading treatment upon one detainee’s mere say so,” saad a pahayag.
“Aside from this claim, the court failed to see any threats against the safety and life of the accused Teves, Jr. mentioned in the motion and how letting him remain in the custody of the NBI facility will secure him against said threats,” dagdag pa.
Sinabi ng Korte na tila pumipili si Teves ng detention facility “for his own convenience.”
Matatandaan na nauna nang ipinag-utos ng Manila RTC Branch 12, ang humahawak ng
kaso ni Teves sa illegal possession of firearms and explosives, na ilipat ito sa Manila City Jail.
Pinigilan ni NBI Director Jaime Santiago ang paglilipat at sinabing may iba-ibang korte ang humahawak sa mga kaso ni Teves at maaaring ipag-utos ang detention nito sa ibang lugar.
Si Teves at iba pang sangkot ay kinasuhan sa umano’y pagpatay ng tatlong indibidwal sa Negros Oriental noong 2019.
