MANILA, Philippines – Nilagdaan ni Pangulong Ferdinand R. Marcos Jr. ang batas na ang hangarin ay makapagbigay sa mga Filipino Muslims ng ‘better access’ sa Shari’ah courts sa pamamagitan ng digitalisasyon.
Nito lamang Sept. 18, pinirmahan ni Pangulong Marcos ang Republic Act (RA) 12304, na mag-aamiyenda sa RA 9997 o National Commission on Muslim Filipinos (NCMF) Act of 2009.
Sa ilalim ng RA 12304, “the NCMF and the Deparent of Information and Communications Technology (DICT), in coordination with the Supreme Court, will create a digital platform to allow paperless filing of pleadings and other court submissions.”
Makikipag-ugnayan din ang NCMF sa Philippine Statistics Authority (PSA) sa tamang koleksyon ng statistical data para sa Muslim Filipino sa national, regional, provincial, city, at municipal levels.
“The Commission and the PSA shall prepare an annual report which shall include the data on Muslim births, marriages, and deaths for the year based on the transmitted registered civil registry documents from local civil registry offices, Shari’ah Circuit Registrars, and the Philippine Foreign Service Posts Abroad,” ang nakasaad sa RA 12304.
Ang Bureau of Legal Affairs ng NCMF ay inatasan na magbigay sa mga Muslim Filipino ng legal education at tulong kung sakaling may pagsasakdal sangkot ang kanilang mga tao o interest.
Ayon sa RA 12304, “the bureau will also act as the legal counsel of the NCMF, investigating cases involving its personnel and valid complaints brought before the Commission.”
Ang legal affairs bureau ay mayroon ding mandato na tiyakin ang pantay na pag-access sa Shari’ah Courts at madaliin ang paghahain o pagsusumite ng wastong dokumento sa tamang Shari’ah Court for Muslim Filipino litigants na nasa rehiyon kung saan walang umiiral na Shari’ah Court.
Ang NCMF ay inatasan na magsumite ng annual report hinggil sa implementasyon ng RA 12304 sa Senate President, House Speaker, at mga chairperson ng Senate Committee on Cultural Communities and Muslim Affairs at House Committee on Muslim Affairs.
Ang RA 12304 ay magiging epekto, 15 araw matapos na mailathala ito sa Official Gazette o sa pahayag na may general circulation. (KRIS JOSE)
