MANILA, Philippines – Isang memorandum of agreement ang binabalangkas ngayon ng Department of Justice para sa mga whistleblower o mga potensyal na saksi ng estado sa flood control scandal, sinabi ni Undersecretary Jesse Andres nitong Huwebes, na ibinunyag na ang ilan sa kanila ay nagsaad ng boluntaryong pagbabalik ng hanggang P1 bilyon ng mga “ninakaw” na pondo.
Ayon kay Andres, ang pagsasauli o pagbabalik ng “ninakaw” na pondo ay “part and parcel” ng memorandum of agreement na ginagawa sa mga whistleblower.
“Definitely restitution or bringing back to the government the ill-gotten wealth, the misused funds, and all the assets that they amassed using these misused funds will have to be returned,” aniya.
“The whistleblowers are already volunteering to return funds, and I should say substantial funds reaching even P1 billion,” dagdag niya.
Kabilang sa mga itinuturing na tatanggapin sa witness protection program ng gobyerno ay ang mga dating public works engineer na sina Henry Alcantara, Brice Hernandez, Jaypee Mendoza, at Arjay Domasig, gayundin ang flood control contractor na si Sally Santos, ani Andres.
Sinabi ni Andres na sapat na ang ebidensyang taglay ng mga whistleblower para mapanagot ang mga makapangyarihang personalidad sa likod ng kontrobersiyang katiwalian sa ilalim ng batas.
“We are nearing the completion of the memorandum of agreement with the major whistleblowers, and this will constitute all or most of the evidence to pin down higher proponents,” aniya.
Sa ngayon ang DOJ ay nasa “culminating point” sa case buildup, ayon kay Andres, “because most of the whistleblowers are now fully cooperating.”
Ipinaliwanag ni Andres na ang mga whistleblower na bibigyan ng state witness status ay hindi makakatanggap ng blanket immunity ngunit sa halip ay nasa case-by-case basis.
“Their cooperation will lead probably to them being exempted from immunity from criminal prosecution for particular cases and/or possibly a lower penalty if they plea bargain,” aniya.
“So, for this particular case, where your knowledge and information, your testimony will be used, you will be criminally exempt from prosecution only for that particular case but for other matters, you will not be exempt from criminal prosecution,” dagdag pa niya. RNT/MND
