MANILA, Philippines — Iniutos ng Bureau of Internal Revenue (BIR) ang pag-isyu ng Letters of Authority (LOAs) para magsagawa ng tax audit kay Vice President Sara Z. Duterte, sa kanyang asawa na si Manases Carpio, at siyam na mga business entity na konektado sa kanila.
Sa isang pahayag noong Martes, sinabi ng BIR na kabilang sa mga sasailalim sa audit ang Carpio Lawyers (dating Carpio and Duterte Lawyers), Zelta Matiem Salon, City Hall King Chow Foods Corporation, Davao Bounty Times Foods Corporation, Madayaw Fisheries Inc., Davao Emerging Taipans Corporation, Amianan Shores, Inc., Cale88 Foods Corporation, at Geometry Security and Investigation Agency, Inc.
Ayon sa ahensya, may “probable cause” upang magsagawa ng pormal na audit investigation. Ang LOA ay nagbibigay awtoridad sa mga revenue officer na suriin ang mga aklat ng mga taxpayer at iba pang financial records.
Sinabi rin ng BIR na ang pag-isyu ng LOA ay batay sa third-party information, kabilang ang mga datos mula sa pampubliko at opisyal na sources, alinsunod sa National Internal Revenue Code.
Kabilang din dito ang testimonya mula sa Office of the Ombudsman hinggil sa Statements of Assets, Liabilities and Net Worth (SALNs) ni Vice President Duterte, pati na ang mga ulat ng Anti-Money Laundering Council na inilabas sa impeachment proceedings sa House of Representatives noong Abril 22.
“A Letter of Authority is the legal instrument of the BIR to initiate formal tax audits of any taxpayer. It is not a conclusion of liability, but it is a necessary step in determining the correct taxes due,” ayon kay BIR Commissioner Charlito Martin Mendoza.
“Accountability begins with the consistent application of the law. Where there is a basis to investigate, the BIR will do so. And if evidence of tax violations exists, it is our duty to pursue the appropriate civil, administrative, or criminal remedies,” aniya pa.
