MANILA, Philippines – Tinutulan ng defense team ni Vice President Sara Duterte nitong Martes, Agosto 4, ang hakbang ng prosekusyon na markahan bilang ebidensya ang bahagi ng affidavit ni dating police officer Arturo Lascañas, dahil umano’y hindi ito notarized, walang lagda, at hindi kinilala ng isang kuwalipikadong saksi.
Sa ika-12 araw ng impeachment trial ni Duterte, sinabi ni lead defense counsel Sheila Sison na ang pagtutol ay alinsunod sa nauna nilang pagkontra sa pagbasa ni National Bureau of Investigation Director Melvin Matibag sa affidavit habang tumitestigo.
“I would just like to put on record that we are objecting even to the marking of this particular exhibit, consistent with the ruling of this court when we objected to the reading of the affidavit by NBI Director Melvin Matibag when he testified and was cross-examined by defense counsel Atty. Mark Vinluan,” ani Sison.
“We object to the marking of this portion of Arturo Lascañas’ affidavit. As of this point, no witness has yet testified on this affidavit, and it’s on record—if we review the records of the court—that that supposed affidavit was unnotarized and was not signed by anybody, let alone identified by any competent witness,” dagdag niya.
Naunang sinabi ni Matibag, na tumestigo kaugnay ng Article IV ng Articles of Impeachment, na sinuri ng NBI ang affidavit bilang bahagi ng imbestigasyon sa umano’y “pattern of violence” na iniuugnay sa mga banta ni Duterte laban kina Pangulong Ferdinand “Bongbong” Marcos Jr., First Lady Liza Araneta-Marcos, at dating Speaker Martin Romualdez.
Ayon kay Sison, hiniling ng prosekusyon na markahan ang bahagi ng dokumento sa pamamagitan ng mosyon para sa isang conference hinggil sa paglilipat ng exhibit markings. Iginiit niyang ipinapalagay nito na mayroon nang naunang marking.
“The motion is to set a conference for the transfer of exhibit markings. Now, this presupposes there has already been an original marking,” ani Sison.
“We will not agree, and if the presiding officer allows even the pre-marking or marking of this item under this motion, then we would like our continuing objection to the allowance of the marking of this particular exhibit to be put on record,” dagdag niya.
Naunang inakusahan ni Lascañas, isang umaming miyembro ng orihinal na Davao Death Squad, si Duterte na nagpasimula umano ng “Oplan Tokhang” noong alkalde siya ng Davao City noong 2012.
Sinabi niyang nagsumite siya sa International Criminal Court ng 186-pahinang affidavit na naglalaman umano ng impormasyon tungkol sa mga pagpatay sa ilalim ni dating Pangulong Rodrigo Duterte at sa sinasabing pagkakasangkot ng Bise Presidente sa extrajudicial killings sa Davao City.
Nakasaad sa bahaging binasa ni Matibag na ang Oplan Tokhang at “the evil side of its enforcement” ay binuo umano noong 2012 hanggang 2013 ng noo’y Davao City Police Office director at ngayo’y Sen. Ronald “Bato” Dela Rosa. Nakasaad din na ang mga operasyon ay “cleared and approved” umano nina Sara Duterte at ng kanyang ama.
Nanindigan ang depensa na hearsay ang affidavit at maaaring iligaw ang mga senator-judge at publiko hinggil sa katotohanan ng mga nilalaman nito. RNT
