MANILA, Philippines – Kabaligtaran ng posisyon ng tatlong dating Supreme Court justices, nanindigan si retired Supreme Court Associate Justice Adolfo Azcuna na dapat 24 ang “all members of the Senate” ang pagbabatayan sa bilang voting threshold.
Sa kanilang pagharap sa impeachment court, ihayag ni Azcuna na habang kumpleto ang lahat ng miyembro ng Senado, sila ang denominator sa pagtutuos ng threshold na two-thirds dahil sinabi ng Saligang Batas ang salitang “all.”
Taliwas ito sa posisyon nina Retired Chief Justices Hilario Davide Jr., Artemio Panganiban, and Reynato Puno na pumili ng ibang constitutional approaches na nagkasundo na pagbabasehan ang bilang ng senador kung sino ang legal na nakakadalo sa impeachment trial upang ma-convict ni Vice President Sara Duterte,

Ayon kay Azcuna, ang two-thirds requirement ay sinadya bilang supermajority para protektahan laban sa factional at partisan abuse.
“The supermajority rule protects against factional and partisan abuse. The framers of the supermajority impeachment clause were reacting to a specific fear that impeachment could become a tool for a transient legislative majority to remove a political rival or an official from a disfavored party, effectively overturning an election result through legislative fiat rather than through the ballot box,” babala niya.
“Requiring two-thirds forces conviction to rest on a coalition that cuts across ordinary partisan lines, which is precisely the point. It signals that the wrongdoing is serious and broadly, not merely factionally, recognized,” paliwanag pa niya.
Dagdag ni Azcuna, dapat fixed at hindi pabago-bago ang threshold. “A threshold must be fixed, not variable. It must be determinable from the start,” aniya, at ang pagbabase lamang sa mga lumahok na senador ay magpapababa sa safeguard na ito.
Nilinaw din niya sa interpelasyon ng mga senator-judge na mababakante lamang ang isang puwesto sa kaso ng kamatayan, pagbibitiw, o pagkatanggal sa opisina.
Ang pagdinig sa amici curiae ay isinagawa habang apat na senator-judge — sina Jinggoy Estrada, Rodante Marcoleta, Ronald dela Rosa at Loren Legarda — ang hindi nakadalo nang tuloy-tuloy dahil sa detention bunsod ng plunder charges, pagtatago, o medical leave sa abroad. Ernie Reyes
