MANILA, Philippines – Pinagtanggol ni House Assistant Majority Leader Zia Alonto Adiong ang desisyon ng Office of the Secretary General na hindi tanggapin ang impeachment complaint laban kay Pangulong Ferdinand Marcos Jr. habang wala ang House secretary general.
Aniya, ang pagsusumite ng impeachment complaint ay “not a walk-in transaction.”
Ayon kay Adiong, ang House rules at long-standing parliamentary practice ay nag-uutos na ang complaint ay dapat opisyal na isumite sa secretary general, ang tagapag-ingat ng rekord ng Kamara.
“It is a formal constitutional act that must strictly comply with House Rules. It cannot be improvised, delegated casually, or reduced to a mere drop-off,” dagdag niya.
Iginiit din niya na hindi simpleng ministerial act ang pagtanggap ng complaint, dahil kailangan nilang tiyakin na ito ay sumusunod sa constitutional at procedural requirements, kabilang ang verification, endorsements, at supporting documents.
“This is not a mechanical function that can be exercised without authority or accountability,” sabi ni Adiong. “Once they have officially accepted the complaint, they have to transmit it to the Speaker, and it has a direct bearing on the effect of the one-year ban.”
Binanggit niya rin na maaari itong magdulot ng procedural challenges at irregularity claims kung tatanggapin ang complaint nang wala ang secretary general, na maaaring maging “far more serious breach of duty.”
Ang pahayag ni Adiong ay kasunod ng insidente noong Huwebes nang hindi tinanggap ang dalawang impeachment complaints laban kay Marcos dahil wala si House secretary general Cheloy Garafil, na nasa Taiwan upang tumanggap ng award.
Sinabi ng mga nag-sumite ng complaint, kabilang ang Bagong Alyansang Makabayan at ilang dating opisyal tulad nina Chavit Singson at Michael Defensor, na humihingi ng impeachment dahil sa alegasyon ng betrayal of public trust kaugnay ng flood control scandal at budget anomalies.
Ngunit pinawalang-bisa ng executive director ng Office of the Secretary General ang kanilang pagsusumite, sabi niyang wala siyang awtoridad na tanggapin ito sa kawalan ni Garafil, kahit na hindi malinaw sa rules of procedure na ang head mismo ang dapat tumanggap. RNT/MND
