Bank records nina VP Sara, Carpio, may “presumption of regularity” – Impeachment Court

MANILA, Philippines – Ipinag-utos ng Senate impeachment court nitong Martes na na ituring na may presumption of regularity ang lahat bank record nina Vice President Sara Duterte at ng asawa nitong si Atty. Manases Carpio na isinumite sa korte.

Ginawa ang ruling ni presiding officer Senator-Judge Chiz Escudero matapos tumangging pumayag ang defense team ni VP Duterte na “i-stipulate” o tanggapin na authentic ang mga bank record na isinumite ng mga bangko.

Dahil dito, kinailangan ng prosecution na magharap ng mga opisyal ng bangko para kumpirmahin ang authenticity at balance ng mga account.

“To the extent that any record independently qualifies as an official record and is entitled to a presumption of regularity, that presumption is rebuttable and does not establish the truth or accuracy of every entry,” sabi ni Escudero sa Day 34 ng paglilitis.

Ayon kay Escudero, alinsunod ito sa Rule 4, Section 1 ng Rules on Evidence na itinuturing na katumbas ng original document ang electronic document basta printout ito na tumpak na nagpapakita ng data.

Idinagdag niya na maaari pa ring kwestyonin ang mga record kung may maipakitang “fraud, falsification, material alteration, irregularity, incompleteness, palpable mistake, unreliable method of preparation, a break in a chain of custody or lack of personal knowledge.”

Ginamit rin ni Escudero ang desisyon ng Korte Suprema sa kasong Republic v. Marcos na nagsasabing hindi awtomatikong nagiging public record ang mga pribadong dokumento kahit nasa kustodiya ng gobyerno.

“The court relies not on custody alone but the records, direct production by the institutional custodians pursuant to the subpoenas, their documented receipt and safe keeping by the clerk of court,” paliwanag ni Escudero. “We are not depriving the respondent of any of its available rights to question the authenticity of the documents,” dagdag niya.

P190-M sa 30 account, hindi nakadeclare sa SALN
Sa pag-offer ng ebidensya, sinabi ng private prosecutor na si Atty. James Alih na layon ng mga testigo mula sa bangko na patunayan na may 30 aktibong bank accounts sina VP Duterte at Carpio mula 2022 hanggang 2025 na may kabuuang P190 milyon na ending balance hanggang 2025.

Ayon kay Alih, hindi ito nakarehistro sa SALN na magkasamang isinumite ni VP Duterte at Carpio dahil wala silang idineklarang “cash on hand” o “cash in bank” mula 2019 hanggang 2025.

Kinumpirma ito noon sa korte ni Atty. Karen Batu ng Office of the Ombudsman.

Dalawang opisyal ng LandBank ang humarap nitong Martes:

1.     Eunice Sumatra – Branch Head, LandBank San Pedro, Davao Branch. Sinabi niyang aktibo ang payroll account ni VP Duterte sa kanilang sangay.

2.     Raquel dela Cerna – Branch Manager, LandBank Davao Magsaysay Branch. Sinabi niyang may higit P1.3 milyon na ending balance si Carpio sa kanyang account sa kanilang bangko hanggang dulo ng 2025. Ernie Reyes
