MANILA, Philippines – Kailangang magsumite ng sworn declaration on conflict of interest ang mga kandidato sa Barangay and Sangguniang Kabataan Elections sa Nobyembre bilang bahagi ng kanilang Certificate of Candidacy, ayon sa Commission on Elections nitong Martes, Agosto 4.
Sa isang minute resolution, inaprubahan ng Comelec en banc ang rekomendasyon ng Law Department na isama ang deklarasyon sa COC.
“The Commission, after due deliberation, resolved, as it hereby resolves, to approve the recommendation of the Law Department relative to the inclusion of a Sworn Declaration on Conflict of Interest in the Certificate of Candidacy…” saad sa resolusyon.
Sa deklarasyon, nangangako ang mga kandidato na susunod sa mga probisyon laban sa conflict of interest sa ilalim ng Republic Act Nos. 3019 at 6713 kapag sila ay nahalal.
“I undertake, once elected to comply with the provisions on conflict of interest under Republic Act No. 3019 and 6713, particularly as to the prohibition on having direct or indirect financial or pecuniary interest in any business contract, or transaction that may be opposed to or affected by the faithful performance official duty, or in which I am prohibited by the Constitution or any law form having any interest.”
Sinabi ng Comelec Law Department na pinahihintulutan ng Section 52(g) ng Omnibus Election Code ang poll body na magtakda ng mga election form.
Nilinaw nito na hindi karagdagang kuwalipikasyon sa pagtakbo sa pampublikong posisyon ang deklarasyon, kundi pagkilala lamang sa obligasyong sumunod sa umiiral na mga batas.
“These are not new conditions imposed for purposes of candidacy. More importantly, the declaration will promote transparency and place each aspirant/candidate on record regarding financial interests that may affect the faithful performance of official duty,” ayon sa Law Department.
