NAGBIGAY ng pahayag si Senate President Chiz Escudero, wala umano sa lugar ang Kamara na hindi sumunod sa ipinag-uutos ng impeachment court.Ito ang komento ni Escudero nang tanungin sa posibilidad na i-reject ng Mababang Kapulungan ang ibinalik na articles of impeachment.Ayon sa senador, hindi umano magkapantay ang Senado at Kamara sa bagay na ito. MANILA, Philippines- Tanging ang Supreme Court lamang ang may kapangyarihang makapagsasabi kung labag sa Saligang Batas ang desisyon ng Impeachment Court na ibalik sa Kamara ang pitong Articles of Impeachment na isinampa laban kay Vice President Sara Duterte.
Nilinaw ito kahapon ni Senate President Francis “Chiz” Escudero matapos umani ng pagbatikos sa ilang legal at constitutional experts kabilang ang framers ng 1987 Constitution hinggil sa ipinabalik na articles of impeachment sa Kamara.
Nahaharap si Duterte sa pitong kaso kabilang ang betrayal of public trust at paglulustay ng daang milyong halaga ng confidential funds na ipinamigay sa ilang katao na itinago sa pangalan ng sitsirya at ilang pagkain tulad ng Piattos.
“The only one who can say whether something done by any agency is constitutional or not is the Supreme Court. Not them and not us,” ayon kay Escudero.
Ngunit, sinabi ni Escudero na malinaw na natakda sa Rules of Court na pawang sui generis o ibig sabihin may class of its own ang impeachment court.
“The impeachment court can do whatever it wants to do as long as it gets voted upon. And if anyone disagrees, they are free to take it to the Supreme Court and let’s wait for the Supreme Court to decide,” ayon sa Senate chief.
“But it’s not because one congressman or two congressmen or three or one senator, two or three people think it’s unconstitutional, that it automatically becomes unconstitutional. Only the court can say,” paliwanag pa niya.
Sa botong 18 affirmative votes at limang negative votes, nagdesisyon ang impeachment court na ibalik ang Articles of Impeachment laban kay Duterte sa House of Representatives.
Nakatakda din sa desisyon ng Korte na pinagpapalabas ang Kamara ng certification na hindi nito nilalabag ang Saligang Batas sa pagsusulong ng higit sa isang impeachment complaint sa loob ng isang taon.
Pinasasagot din ng Korte ang Kamara kung maaaring itawid sa 20th Congress at gusto nito at nakahanda silang ituloy ang impeachment compalints laban kay Duterte.
Ngunit, hindi umaksyon ang Kamara kaya ipinagpaliban ang pagtanggap ang Articles of Impeachment at ibinalik sa Senado sa pamamagitan ng isang resolusyon na pinagtibay ng Kapulungan.
“The lower chamber’s acceptance of the Articles of Impeachment is deferred until such a time as the Senate, sitting as an impeachment court, has responded to “clarificatory queries raised by the panel of prosecutors relative to the remand of the subject articles,” ayon sa resolusyon. Ernie Reyes
