MANILA, Philippines – Maituturing na political character ng impeachment process ang naging desisyon ng Senado bilang impeachment court na ibalik sa prosecution panel ang reklamo laban kay Vice President Sara Duterte.
Ito ang iginiit ni dating Solicitor General at constitutional law expert Florin Hilbay sa paninindigan na walang mali sa naging aksyon ng mga senator-judges.
“Impeachment is a political process, and this step taken by the Senate, though novel, fits the nature of that process. Ultimately, all remedies are political and could very well be in the direct hands of the people themselves,” sabi ni Hilbay sa kanyang Facebook post.
Nais lang naman anya ng Senado na suriin muli ng Kamara ang Articles of Impeachment upang malinawan na hindi ito paglabag sa “one year ban” sa pagsasampa ng impeachment case sa isang opisyal.
Idinagdag pa ni Hilbay kailangan lamang din sagutin ng Kamara, bilang nagrereklamo, kung ito ay interesado pang ipagpatuloy ang paglilitis kay VP Sara.
Aminado din ang law expert na ang naging pagboto na 18-5 ng senator-judges ay maaring tingnan na pahiwatig na rin na pulitika ang bumabalot sa kagustuhan na mapatalsik sa pwesto si Duterte.
“The 18–5 vote of the Senate is also a potential signal to the House of the kind of political climate it faces if it decides to pursue the impeachment. The remand gives the House an opportunity for a ‘second look’ at the political terrain, given the results of the recent elections,” paliwanag ni Hilbay.
“If the House rejects the remand, the Senate has no choice but to proceed with trial,” dagdag pa niya. RNT
