MANILA, Philippines – Muling humingi sa Korte Suprema sina Senators Christopher Lawrence “Bong” Go at Robin Padilla na ibasura ang mas mababang bilang ng boto na kailangan para mapatunayang guilty si Vice President Sara Duterte sa kanyang impeachment trial.
Noong Setyembre, bumoto ang mga senador na 13-1, na may 6 na nag-abstain, na ang ibig ng Saligang Batas sa “two-thirds guilty verdict by all members of the Senate” ay tumutukoy lang sa mga “capable of participating.”
Nitong Martes, nagsampa sina Go, Padilla, ang Partido Demokratiko Pilipino-Lakas ng Bayan o PDP-Laban, at iba pa ng petition for certiorari and prohibition laban sa ruling ng impeachment court.
Ayon sa mga petitioner, malinaw sa Konstitusiyon na ang basehan ng boto ay ang lahat ng 24 miyembro ng Senado.
“This case is not about whether the Vice President should be convicted or acquitted. It is about the number the Constitution requires before any conviction can lawfully be rendered. The Constitution says two-thirds of all the Members of the Senate. With twenty-four Senators, that is sixteen,” anila.
Idinagdag nila na kung ang threshold ay nakadepende sa attendance, papayagan nito ang “simple majority to dilute a supermajority the Constitution wrote in express terms, in this trial and in every impeachment after it.”
Sa ngayon, hindi nakadalo sa impeachment proceedings ang apat na senador.
Detenido sina Sen. Jinggoy Estrada at Sen. Rodante Marcoleta dahil sa mga kasong plunder.
Nagtatago naman si Sen. Ronald dela Rosa dahil sa warrant mula sa International Criminal Court.
Nasa labas naman ng bansa si Sen. Loren Legarda para sa medical treatment.
Noong huling bahagi ng Setyembre, ibinasura na ng Korte Suprema ang isa pang petisyon laban sa voting threshold “on procedural grounds, including lack of standing and prematurity.” Ernie Reyes
