MANILA, Philippines – Tinanggihan ng Sandiganbayan ang petisyon para sa piyansa ng siyam na dating opisyal ng Department of Public Works and Highways (DPWH) na nahaharap sa kasong malversation kasama ang dating Ako Bicol Party-list Representative Zaldy Co kaugnay ng umano’y substandard na P289 milyong flood control project sa Oriental Mindoro.
Sa 41-pahinang resolusyon, sinabi ng anti-graft court na naipakita ng prosekusyon na malakas ang ebidensya laban sa mga akusado.
Ang mga hindi pinayagang magpiyansa ay sina Gerald Pacanan, Gene Ryan Altea, Montrexis Tamayo, Juliet Calvo, Dominic Serrano, Dennis Abagon, Lerma Cayco, Felisardo Casuno, at Ruben Santos Jr., na pawang mga dating o kasalukuyang opisyal ng DPWH Region IV-B na may kaugnayan umano sa proyekto.
“The prosecution’s evidence shows that accused Serrano, Cayco, Pacanan, Altea, and Santos made their respective certifications and approvals in the subject disbursement vouchers. As a result, the total amount of P215 million was released to Sunwest, Inc.,” ayon sa Sandiganbayan, na tumutukoy sa contractor ng P289 milyong flood control project.
“There is clear and convincing evidence to show that the accused permitted Sunwest, Inc. to take the subject funds. This appears to have been done by making untruthful statements in a narration of facts,” dagdag pa ng korte.
Nilinaw naman ng Sandiganbayan na ang pagtanggi sa piyansa ay hindi nangangahulugang napatunayang nagkasala na ang mga akusado.
“The Court’s ruling herein is not a prejudgment of the guilt of the said accused. The Court merely determined the weight of evidence for the purposes of bail,” ayon sa korte. Santi Celario
