Implementasyon ng NCAP paiimbestigahan sa Kamara

MANILA, Philippines – Naghain ng resolusyon si 1-Rider Party-list Representative Ramon Rodrigo Gutierrez para paimbestigahan sa Kamara ang kahandaan ng pamahalaan na muling ipatupad ang No Contact Apprehension Policy (NCAP).

Ipinanawagan sa House Resolution No. 1490 ang House committees on transportation and Metro Manila development na imbestigahan ang isyu.

“It is the duty of Congress to exercise its oversight function to ensure that policies implemented by executive and local government agencies are aligned with national laws and that they serve the best interest of the public without infringing upon their fundamental rights,” saad sa resolusyon.

Ani Gutierrez, ang NCAP ay dapat pantay-pantay na ipatupad sa Metro Manila sa ilalim ng kaparehong mga batas, panuntunan, multa, at appeal procedures kahit saang lungsod pa mangyari ang paglabag.

“Are we really ready? Is the policy fair? Are motorists protected? If there are fines, they should be fair — especially for riders who are on the road every day to make a living,” aniya.

Nananawagan din ang resolusyon na suriin kung paano kinokolekta ang footage at personal na datos ng mga camera at sensor, paano ito pinoprotektahan at itinatago, sino ang may kapangyarihan para mangolekta ng multa, at kung paano gagamitin ang mga kinita rito.

“The camera should capture a clear violation. Motorists should not be automatically penalized because of inadequate signage, damaged roads or circumstances beyond their control.”

“Riders are often the first to feel the effects when implementation is inconsistent. We will keep watch over that,” dagdag ni Gutierrez.

Ayon sa resolusyon, dapat tingnan ng dalawang komite ng Kamara ang mga sumusunod na aspeto:

Evaluate the effectiveness of the NCAP in achieving its objectives of traffic management and road safety;
Examine the mechanisms for due process and the accessibility of appeal procedures for motorists issued citations under the policy;
Assess the systems in place to ensure the data privacy and security of information collected through the technology;
Determine the legal authority and applicable rules governing the allocation and intended use of NCAP fines and penalty revenues, including whether these are used for traffic management, road safety, transportation or other authorized public purposes; and
Determine the need for a national legislative framework to standardize automated traffic enforcement, ensuring consistency across different local government units and adherence to constitutional safeguards.

Kabilang sa mga lungsod na nagpatupad na ng NCAP nitong Lunes, Oktubre 5 ay ang Manila, Quezon City, Parañaque, Muntinlupa at San Juan. RNT/JGC
