MANILA, Philippines – Ipinataw ng Office of the Ombudsman kay Insurance Commissioner Reynaldo Regalado ang anim na buwang preventive suspension nang walang sahod dahil sa mga kasong administratibo kaugnay ng Personal Passenger Accident Insurance Program para sa mga public utility vehicle.
Sa kautusang may petsang Hulyo 28, sinabi ng Ombudsman na may sapat na batayan upang suspindihin si Regalado dahil sa mga alegasyon ng grave misconduct at paglabag sa Republic Act No. 6713 o Code of Conduct and Ethical Standards for Public Officials and Employees, at Republic Act No. 11032 o Ease of Doing Business and Efficient Government Service Delivery Act.
Nag-ugat ang mga reklamo sa pag-apruba sa accreditation ng ikatlong insurance consortium sa kabila ng mga kuwestiyon sa membership nito at sa napapanahong paghahain ng aplikasyon.
Inakusahan din si Regalado ng conflict of interest dahil dati siyang senior counsel ng AAQ Law, ang law firm na kumakatawan sa na-accredit na consortium.
“This Office finds sufficient grounds for the issuance of an Order for Preventive Suspension against Regalado considering that there is strong evidence showing his guilt; the charges against him constitute grave misconduct; his continued stay in office may prejudice the investigation of the case filed against him; and, in order to preserve documents and evidence pertaining to this case which he has control and custody, and to avoid Regalado’s commission of further malfeasance and/or misfeasance in office,” saad sa kautusan.
“Regalado was listed as Senior Counsel of AAQ Law. Regalado’s participation in any proceeding involving AAQ Law’s clients casts serious doubt as to his impartiality,” dagdag nito.
Ayon sa Ombudsman, hindi umano tumugon si Regalado sa mga kahilingan para sa mga dokumentong kaugnay ng accreditation, tumangging ilabas ang mga rekord na kailangan sa pag-apela, at hindi isinama ang mga abogado ng complainant sa isang conference sa Insurance Commission.
Nagpakita rin umano siya ng manifest partiality nang aprubahan ang accreditation ng consortium sa kabila ng sinasabing paglabag sa sariling mga regulasyon ng Insurance Commission.
“Regalado’s preventive suspension shall remain effective until the administrative case is terminated. It also declared the suspension immediately executory, notwithstanding any motion or appeal, unless otherwise ordered by the Ombudsman or a court of competent jurisdiction,” nakasaad sa kautusan.
Nahaharap din si Regalado sa hiwalay na reklamong kriminal dahil sa umano’y paglabag sa Anti-Graft and Corrupt Practices Act. Santi Celario
