MANILA, Philippines – Maaari pa rin patawan ng Senate impeachment court ng lifetime ban upang hindi na muling makabalik muli sa politika si Vice President Sara Duterte sakali man na piliin nito na magbitiw sa pwesto, ayon kay 1 Rider Partylist Rep Rodge Gutierrez.
Ayon kay Gutierrez, isa sa miyembro ng 11-man House prosecution panel, na hindi maisasantabi ng pagbibitiw ni VP Sara sa pwesto ang impeachment process na isa sa parusa maliban sa pagtanggal sa pwesto ay perpetual disqualification sa public office.
“The purpose of impeachment is one, removal from office, and two, the penalty of perpetual disqualification from holding a public office. And I believe resignation while it might avoid the first penalty, the second penalty is still there,” paliwaag ni Gutierrez na isang abogado.
Aniya, hindi dapat alisin sa Senate impeachment court ang pagpapataw ng parusa dahil lamang sa pagbibitiw na sa pwesto ng opisyal.
Gayundin ang pahayag ni House Assistant Majority Leader at Lanao del Sur Rep. Zia Alonto Adiong, aniya, ang impeachment trial ay dapat na tumuloy, nasa pwesto man o magbitiw si VP Duterte.
“The process of the impeachment trial is not tied up with the resignation of the certain official na na-impeached,” ani Adiong.
Giniit ni Adiong na alinsunod sa batas, sa oras na maisumite na ang impeachment complaint, ang Senado ay obligado na magconvene bilang impeachment court, dinggin at reklamo at magpalabas ng desisyon.
