MANILA, Philippines – Pinababawi na ng Department of Justice (DOJ) ang mga Dengvaxia cases na isinampa sa korte laban kay dating health secretary Janette L. Garin at dalawang kapwa akusado.
Kinatigan ni Justice Secretary Crispin Remulla ang petition for review ni Garin at dating Department of Health (DOH) undersecretary Gerado V. Bayugo at dating assistant secretary Ma. Joyce U. Ducusin.
Kinuwestyon nila ang naging resolution ng panel of prosecutors na nakakita ng sapat na ebidensya para isampa ang kasong reckless imprudence resulting in homicide sa pagkamatay ng 98 na mga estudyante na tinurukan ng anti-dengue vaccine na Dengvaxia.
Kabilang sina Garin sa mahigit 30 akusado na sinampahan ng kaso sa Quezon City Regional Trial Court (RTC).
“After a careful examination of the evidence on the records of these cases, we do not find a prima facie case with reasonable certainty of conviction against respondents-appellants Bayugo, Ducusin, and Garin,” saad sa resolusyon na pirmado ni Remulla.
Dahil dito, pinawalang-saysay ni Remulla ang naging resolusyon ng oanel of prosecutors.
“The Prosecutor General is hereby directed to withdraw the Information for Reckless Imprudence resulting in Homicide, if any, filed against respondent-appelants Dr. Janette Garin, Dr. Gerado V. Bayugo, and Dr. Ma. Joyce U. Ducusin, and to report to this Office the action within ten (10) days from receipt of this Resolution,” ani Remulla.
Nakasaad sa resolusyon na ang Dengvaxia vaccination program ay hindi basta-basta dinisenyo at ipinatupad at hindi rin ginamit para lamang sa eleksyon.
“Respondents-appellants presented data showing that surges of dengue cases occur during the second semester of every school year. Thus, by starting vaccination on the first semester of the school year, students would have been administered with the prescribed three doses by the second semester of the following year.”
Ipinunto ni Remulla na bago isinagawa ang pagbakuna ay hiningi muna ng mga health workers ang pahintulot ng mga estudyante at nagsagawa ng health assessments.
“It cannot be established that there is any causal link between Dengvaxia vaccination and the deaths alleged in the Complaint-Affidavits.”
Lumabas din aniya sa masusing scientific studies ng World Health Organization (WHO) at ina oang experto na walang kaugnayan ang dengvaxia vaccination sa pagkamatay ng mga bata. TERESA TAVARES
