MANILA, Philippines – Tila isang pag-amin ang paggamit ng depensa ng marked video ng prosekusyon sa umano’y video ng banta ni Vice President Sara Duterte.
Sa pahayag nitong Huwebes, Hulyo 16, sinabi ni private prosecution counsel Lorna Kapunan na ang paggamit ng video ay hindi lamang pagkilala ng depensa sa authenticity nito kundi katumbas ng pag-amin na ginawa nga ito ni Duterte.
“So with the video of the vice president, where she said, ‘I’ve hired an assassin,’ it already has a marking, Exhibit P-4-10, which was also used,” ani Kapunan.
Dahil dito ay hindi na maitatanggi ng depensa na ang recording ay ‘tampered,’ ‘spliced,’ o ginawa gamit ang artificial intelligence.
“The experts are saying it: This is not only an implied admission, but a confession,” sinabi pa ni Kapunan.
“But I’ll say more about that: That’s not only an admission, but that’s a confession,” giit pa nito.
“What does that mean? It’s a confession in which she said it all.”
Ang recording na ito ay mahalaga sa ikaapat na article of impeachment, na nag-aakusa kay Duterte ng culpable violation of the Constitution, betrayal of public trust, at iba pang high crimes sa mga naging pahayag nito laban kay Pangulong Ferdinand Marcos Jr., First Lady Liza Araneta-Marcos, at dating Speaker Ferdinand Martin Romualdez.
“Although they have their own video, our video was what the defense used. So they can’t question it — that it was tampered with, spliced, used artificial intelligence, etc. That’s already admitted.”
Nauna nang tumestigo ang technical witness mula sa NBI patungkol sa source, chain of custody, at authenticity ng recording bago pa ang ikalawang witness na nagpaliwanag naman sa laman nito at resulta ng imbestigasyon ng ahensya.
“Why is there a need to prove it when the defense of the vice president impliedly admitted that these statements were uttered?” sinabi ni Kapunan. RNT/JGC
