MANILA, Philippines – Dapat magbigay ang Philippine National Police (PNP) ng access sa mga police report at iba pang dokumentong may kaugnayan sa drug war killings sa administrasyon ni dating Pangulong Rodrigo Duterte, sinabi ng National Police Commission (NAPOLCOM) nitong Miyerkules, Agosto 27.
Ang pahayag na ito ni Atty, Rafael Vicente Calinisan, Vice Chairperson and Executive Officer ng NAPOLCOM, ay tugon sa tanong ni Akbayan party-list Representative Chel Diokno kung bakit tumatanggi ang pulisya na makipagtulungan sa imbestigasyon ng Commission on Human Rights (CHR) sa mahigit 4,000 drug war deaths sa mga operasyon.
Tinukoy ni Diokno ang pahayag ni CHR Chairperson Richard Palpa-Latoc, na karamihan sa mga istasyon ng pulis ay hindi sumasagot sa mga subpoena ng CHR sa police reports sa drug war killings ayon na rin sa Executive Order No. 2 ni Duterte sa Freedom of Information, na sinasabing ang imbestigasyon ng pulisya ay confidential.
“From what I’ve gathered, Mr. Chair, we had a talk with the previous leadership of the PNP [under General Nicolas Torre III]. In fact, I was there alongside [ML party-list] Representative de Lima. And the direction right now is to actually provide access to investigative bodies because that should be the course of things,” sinabi ni Calinisan sa Philippine National Police briefing sa House Public Order and Safety panel.
“So hopefully, with the new Chief PNP and of course with the National Police Commission who is currently investigating the extrajudicial killings cases [during the Duterte drug war], we will get somewhere,” dagdag ni Calinisan, na tumutukoy kay bagong PNP chief, Police Lieutenant General Jose Melencio Nartatez Jr.
Ang NAPOLCOM ay ahensyang binibigyan ng mandato sa pangangasiwa at pagkontrol sa PNP.
Nagpaalala si Diokno sa NAPOLCOM at PNP na ang exception sa ilalim ng EO ni Duterte sa FOI ay hindi dapat gamitin para itago ang mga police document na may kaugnayan sa drug war killings na ginawa ng pulisya dahil ang EO ay hindi nagbibigay ng ‘absolute exceptions.’
“While it does provide that information concerning law enforcement are within the exceptions, meron pong kondisyon ‘yun that the government agency can only refuse to provide documents if it will interfere with enforcement proceedings, deprive a person of a right to fair trial, reveal a confidential source, or disclose unjustifiably investigative techniques,” pahayag ni Diokno na isang human rights lawyer.
“Please inform the new chief of the PNP that we need assurances from the Philippine National Police that they will provide full cooperation with the CHR in its fulfillment of its mandate,” dagdag pa nito.
Noong Marso ay inaresto si Duterte at dinala sa International Criminal Court sa The Hague, Netherlands sa mga reklamong crimes against humanity, na may kaugnayan sa drug war killings ng kanyang administrasyon. RNT/JGC
