MANILA, Philippines – Walang legal na basehan ang polisiya ng Philippine National Police (PNP) kaugnay sa mga tattoo sa mga tauhan nito at aplikante, pahayag ni Manila Rep. Joel Chua.
Ani Chua, walang basehan sa mga kasalukuyang batas laban sa pagkakaroon ng mga tattoo, partikular na binanggit nito ang Republic Act (RA) 6713 o ang Code of Conduct and Ethical Standards for Public Officials and Employees, at RA 6975 o ang batas na nagtatatag sa PNP.
Hindi rin umano kasama ang naturang PNP policy sa general qualifications for appointment o disqualifications sa Section 30 ng RA 6975.
Aniya, ang polisiya ng PNP sa mga tattoo ay pwedeng tawaging “unconstitutional” dahil ang tattoos ay itinuturing ding uri ng artistic expression at protektado ng karapatan sa free expression.
“The PNP should discard that policy now before they get into legal trouble for the unconstitutionality of their policy. Tattoos are an art form of expression. The Constitution protects freedom of expression. By all indications, the PNP policy on tattoos is unconstitutional,” saad sa pahayag ni Chua.
Batay din sa September 29, 2021 ruling ng Korte Suprema, hindi rin nito pinagbabawal ang mga judge sa pagkakaroon ng tattoo.
“It is disappointing that our PNP has this negative mindset about people with tattoos. Tattoos have nothing to do with the job performance of any police or public servant,” ani Chua.
“It is the membership in the criminal organization that must be proven first. Tattoos are not probable cause for that – not even membership in jail gangs – because it is the criminal activity that must be proven to actually exist, not the mere presence of the tattoos,” dagdag pa niya.
Samantala, ipinunto ni Chua na ang nag-iisang batas lamang na kabilang ang tattoo bilang diskwalipikasyon ay para sa blood donation.
“Recent tattoos not more than one year disqualify the applicant from giving blood, but if the tattoo is more than one year ago, the blood donor may give blood,” anang mambabatas.
Kamakailan ay sinabi ni PNP spokesperson Col. Jean Fajardo na dapat alisin ng kanilang mga tauhan ang anumang “visible” tattoos.
“For some, sinasabing creative art ito , expression of oneself, belief sa artistic side po nila but in every right, there are boundaries. Dito ay nasa loob tayo ng uniformed service kasi pangit na naka-uniform ang pulis natin na tadtad ng tattoo,” pagbabahagi ni Fajardo sa mga mamamahayag.
Hindi naman sakop ng polisiya ang aesthetic tattoos, katulad ng eyebrows, eyeliner, o sa mga labi. RNT/JGC
