MANILA, Philippines – Iginiit ng state prosecutors na ang kanilang mosyon na maghain ng amended information para ialis si dating Public Works and Highways Secretary Manuel Bonoan mula sa plunder at graft cases, ay hindi magdudulot ng prejudice sa co-accused nito.
“It is our position that it is just a textual change,” sinabi ni Assistant State Prosecutor III Reza Casila-Derayunan.
“It’s not a substantial amendment but merely describes the mechanism of an act already charged in the original information,” dagdag pa niya.
“It does not prejudice the others.”
Ang co-accused ni Bonoan ay sina Senador Jinggoy Estrada at DPWH officials na sina Denryl Caesar Sanchez Cortuna, Manny Bumagat Bulusan, at Arturo Lombres Gonzales Jr.
Kinontra ng abogado ni Estrada na si Atty. Laurence Hector Arroyo ang mosyon ng state prosecutors at sinabing ito ay prejudice sa senador.
“Our expectation is that Secretary Bonoan will be denying the charge in this case,” sinabi ni Arroyo.
“We’ll be deprived of that defense.”
Ganito rin ang iginiit ng counsel ni Cortuna na si Atty. Eldrige Aceron at sinabing ang pag-amyenda sa impormasyon na mag-aalis kay Bonoan sa kaso ay makakaapekto sa kanyang kliyente.
“Cortuna’s defense is that there was no unity of purpose between his level of implementation and that of other officials at the national level,” sinabi ni Aceron.
“When they changed the text of the information from ‘Estrada and Bonoan’ to ‘Estrada and/or/through Bonoan,’ there is now prejudice,” dagdag pa.
Sinabi naman ni Fifth Division Chairperson Hon. Zaldy Trespeses na ang mosyon ng state prosecutors ay deemed submitted na para sa resolusyon kasunod ng clarificatory hearing.
Umaasang mareresolba ng korte ang naturang usapin bago ang July 28 na arraignment nina Estrada at Bonoan.
Sina Bonoan, Estrada, at tatlo pang co-accused nito ay nahaharap sa graft at plunder charges sa umano’y iligal na budget insertions at project allocations na nagkakahalaga ng P573 milyon ng DPWH infrastructure portfolio para sa fiscal year 2025.
Sa kabila nito ay sinabi ng Office of the Ombudsman na plano nitong alisin si Bonoan at gawing state witness para makatulong na imbestigahan pa ang ibang kaso laban sa flood control scandal. RNT/JGC
