MANILA, Philippines – Ayaw pa ring pangunahan ng prosekusyon ang impeachment court ukol sa pagpapasubpina sa mga dokumento nina Vice President Sara Duterte at kaniyang asawa na si Atty. Manases Carpio mula sa Bureau of Internal Revenue (BIR).
Sinabi ito sa isang press conference nina Prosecution Legal Spokesperson Atty. Jay Tolosa at Rep. Zia Alonte Adiong, isa rin sa mga Prosecution Spokesperson para pagdesisyunan ang kahilingang ito ng prosekusyon maging ang mga dokumento mula sa Anti-Money Laundering Council (AMLC) at sa BIR.
“”We will not pre-empt the action to be taken by the impeachment court on this at the discretion of the impeachment court but we are very hopeful that they will grant it based on the strong legal basis,” ayon kay Tolosa.
Sinabi rin ni Adiong na “we do not speculate but we are optimistic that Senate will grant the request of the House (of Representatives) Prosecution panel.”
Sinabi pa ni Tolosa na positibo ang prosekusyon na aayunan ng impeachment court ang kanilang posisyon na hindi na kailangan ang pagsang-ayon ng pangulo sakaling payagan dahil ito aniya ay nakasaad sa kunstitusyon.
“Ang unang posisyon ho namin dito ay mas supreme ang kunstitusyon natin which grants the impeachment court the sole authority to decide and try on the impeachment proceedings. Kasama ho dito ang kapangyarihan nila ay mag-isyu ng subpina.”
Paliwanag oa ni Tolosa na ang kunstitusyon ay mas mataas kaysa sa isinasaad sa probisyon ng Internal Revenue Code. Meliza Maluntag
