MANILA, Philippines – Sinimulan na ng Senado ang pagtalakay sa isang resolusyon na naglalayong tiyakin na ang mga Pilipinong inaakusahan ng krimen sa ibang bansa ay mabibigyan muna ng pagkakataong gamitin ang legal remedies sa mga korte ng Pilipinas bago sila isuko sa international tribunals tulad ng International Criminal Court (ICC).
Inisponsor ni Senator Rodante Marcoleta ang proposed Senate Resolution No. 307 sa plenary session, at iginiit na hindi lamang ito para kay dating Pangulong Rodrigo Duterte o sa mga kasong may kaugnayan sa ICC.
“This is not obstruction, Mr. President. This is not delay for delay’s sake. This is the minimum requirement of Constitutional fairness. Justice to be legitimate must be both firm and fair, and fairness demands that before the irreversible act of surrender, the Filipino citizen, any Filipino citizen, be allowed to invoke the protection of Philippine courts,” ani Marcoleta.
“This is not the defiance of international law, Mr. President. This is fidelity to the Constitution,” dagdag niya.
Ayon kay Marcoleta, layunin ng resolusyon na tiyakin ang due process sa pamamagitan ng pagbibigay ng sapat na panahon sa mga Pilipino upang makapaghain ng legal remedies sa mga lokal na korte bago ang extradition o surrender.
“This resolution does not obstruct justice. It does not shield wrongdoing. It simply demands that prior to surrender or extradition, a Filipino be given reasonable time to access the courts. Is this not the very essence of due process?” ani niya.
Inihain ang resolusyon noong Pebrero 18 ng Senate minority bloc upang protektahan ang mga Pilipino laban sa extraordinary rendition at matiyak ang kanilang access sa legal remedies.
Nagbigay rin ng co-sponsorship speeches sina Senators Imee Marcos, Jinggoy Estrada, Bong Go, at Robin Padilla.
Nagaganap ang deliberasyon habang sinimulan na ng ICC ang confirmation of charges proceedings laban kay Duterte kaugnay ng umano’y crimes against humanity sa kanyang war on illegal drugs. Binanggit din ng ICC prosecutors sina Senators Bong Go at Ronald “Bato” Dela Rosa bilang umano’y co-perpetrators sa mga pagpatay noong alkalde pa si Duterte ng Davao City.
