MANILA, Philippines – Pinagkokomento ng Korte Suprema ang mga respondent kaugnay sa postponement ng 2026 Barangay at Sangguniang Elections (BSKE).
Kabilang sa mga respondent na inatasan ng SC na magkomento sa certiorari and prohibition petition na inihain ni Atty. Romulo Macalintal ang Commission on Elections (Comelec), Office of the President, Executive Secretary, at House of Representatives.
Kinuwestyon ni Macalintal sa SC ang legalidad ng R.A 12326 o ang batas para ipagpaliban ang 2026 BSKE ngayong Nobyembre 2,2026.
Giit ng abogado, ang bagong batas ay nilabag ang electorate’s rights o karapatan ng mga botante na bumoto sa pamamagitan ng pagpapaliban sa 2026 BSKE sa ilalim ng pagkukunwari ng pag-aayos ng termino ng mga opisyal sa panunungkulan.
Iginiit niya na kung epektibong pinapayagan ang mga kasalukuyang opisyal ng barangay at SK na humawak sa kanilang mga posisyon sa loob ng tatlong taon o mula Disyembre 2025 hanggang Nobyembre 2028.
Sa pahayag naman ni Macalintal ukol sa hakbang ng Korte Suprema, sinabi niya na nagsimula pa lang ang laban at hindi pa tapos.
“I am deeply glad and thankful that the Supreme Court immediately acted on our petition challenging Republic Act No. 12326, which unconstitutionally postpones the Barangay and Sangguniang Kabataan Elections (BSKE),” ayon sa inilabas na pahayag ni Macalintal sa media.
“The directive of the Supreme Court resolution ordering the Office of the President, the Senate, the House of Representatives, and the Commission on Elections (Comelec) to file their comments on my petition and motion for TRO within a non-extendible period of just five (5) calendar days is a welcome development and a clear indication that the High Court sees substantial merits in our petition.
Considering the strict 5 days given to the respondents to submit their comments, I am highly confident that a favorable resolution will be issued by our Supreme Court in the very near future,” dagdag pa niya. Jocelyn Tabangcura-Domenden
