MANILA, Philippines – Pinagtibay ni Solicitor General Darlene Berberabe na kumilos alinsunod sa batas ang pamahalaan ng Pilipinas nang arestuhin nito si dating Pangulong Rodrigo Duterte noong Enero at isinuko siya sa kustodiya ng International Criminal Court (ICC) sa The Hague.
Sa isang pahayag nitong Martes, Pebrero 17, sinabi ni Berberabe na ipinaabot ng Office of the Solicitor General (OSG) sa Korte Suprema ang posisyon nito kaugnay ng mga petisyon na inihain ng mga anak ni Duterte, kabilang ang writ of habeas corpus at petisyon para sa certiorari na kumukuwestiyon sa kanyang pag-aresto.
“The OSG maintained that the government acted in accordance with both international law and Section 17 of Republic Act No. 9851 (the Philippine Act on Crimes Against International Humanitarian Law, Genocide, and Other Crimes Against Humanity),” ayon sa pahayag.
“It stressed that the legal requirements for surrender of the former President were met, namely: (a) another court or international tribunal is conducting the investigation or prosecution; (b) surrender is in the interest of justice; and (c) surrender complies with applicable laws and treaties,” dagdag nito.
Iginiit din ng OSG na iginalang ang mga karapatan ni Duterte sa buong proseso. “The former President’s rights and privileges were respected throughout the process” ng kanyang pag-aresto at pagsuko sa ICC, at “He was accompanied by counsel, and family access was not restricted.”
Nauna nang hiniling ng OSG sa Korte Suprema na ibasura ang pinagsamang petisyon ng mga anak ni Duterte dahil umano’y moot at walang sapat na batayan. Sinabi rin nito na ang writ of habeas corpus ay walang “extraterritorial effect” dahil nasa kustodiya na ng ICC si Duterte sa The Hague. Gayunman, iginiit ng mga anak ni Duterte na nananatiling balido ang kanilang petisyon.
Kasalukuyang nakakulong ang 80-anyos na dating Pangulo sa ICC Detention Center sa Scheveningen, The Hague, kaugnay ng kasong crimes against humanity na may kinalaman sa war on illegal drugs noong siya ay alkalde ng Davao City at kalaunan bilang Pangulo ng Pilipinas.
Nakatakdang magsimula ang confirmation of charges hearing sa Pebrero 23. Ayon sa kanyang defense counsel na si Nicholas Kaufman, si Duterte ay “will not participate in the confirmation hearing through video-conferencing.”
“Nor did the former President willingly appear by way of such technology at his initial appearance,” dagdag ni Kaufman.
Samantala, inaasahang personal na dadalo ang mga kaanak ng mga biktima ng drug war sa pagdinig at magsasagawa ng solidarity activities sa labas ng ICC. RNT
