MANILA, Philippines – Pinayagan ng Sandiganbayan ang testimonya ng state witness na si dating Department of Public Works and Highways District Engineer Henry Alcantara kaugnay sa malversation case ng pamahalaan laban kay dating Ako Bicol party-list Representative Zaldy Co at 15 iba pa sa umano’y P289 milyong flood control project sa Naujan, Oriental Mindoro.
Ang desisyon na ito ng Sandiganbayan ay sa kabila ng pagtutol ng defense counsel ng siyam na dating opisyal ng DPWH Region 4B na inaakusahan sa malversation case.
Anila, ang testimonya ni Alcantara ay irrelevant at immaterial dahil ang mga dating DPWH engineer ay hindi sangkot sa flood control project sa Oriental Mindoro.
“While his (Alcantara) testimony may appear irrelevant in certain aspects, we have to the take the totality of the intended testimony of the person,” ani Sandiganbayan Associate Justice Kevin Vivero.
“It is very clear that it will touch upon the supposed beneficial ownership of accused Zaldy Co [of Sunwest Inc.] that shows the relevance of this witness,” dagdag ni Vivero.
Si Co ay isa sa mga founder ng Sunwest Inc., contractor ng P289 million flood control project sa Oriental Mindoro na subject ng malversation case.
Ang judicial affidavit ni Alcantara ay inadopt bilang kanyang direktang testimonya.
Samantala, hindi dumalo sa isinagawang cross exmination kay Alcantara ang mga defense counsel ng mga akusado sa kaso.
Si Alcantara ay isa sa apat na state witness sa mga kasong may kaugnayan sa flood control projects kasama si dating Department of Public Works and Highways (DPWH) Undersecretary Roberto Bernardo.
Nauna nang tumestigo si Bernardo sa Sandiganbayan Sixth Division at sinabing si Co, isa sa mga akusado sa malversation case ay nagbigay sa kanya ng P100 milyong balato sa pamamagitan ni Alcantara.
Sinabi rin ni Bernardo na binigyan siya ni Co ng balato dahil siya ang isa sa nagsiguro kay Co na si Alcantara ay ‘someone who is dependable.’ RNT/JGC
