MANILA, Philippines – Hiniling nina Akbayan Rep. Perci Cendaña at ilang labor groups sa Korte Suprema (SC) na imbestigahan ang Pasig Regional Trial Court Branch 152 matapos itong maglabas ng temporary restraining order (TRO) laban sa P85 minimum wage hike sa Metro Manila.
Sa kanilang liham sa Judicial Integrity Office, sinabi nilang ipinagbabawal ng Article 126 ng Labor Code ang paglalabas ng TRO o injunction laban sa mga proseso ng Regional Tripartite Wages and Productivity Board (RTWPB).
Noong nakaraang buwan, naglabas ang RTWPB-NCR ng wage order na nagtatakda ng P85 umento sa minimum wage sa dalawang bahagi: P60 simula Hulyo 25 at P25 simula Enero 20, 2027.
Ngunit noong Hulyo 30, ipinagpaliban ng Pasig court ang pagpapatupad ng umento hanggang Agosto 13 matapos ang petisyon ng Readycon Trading and Construction Corp. at R-II Builders Inc.
Ayon sa liham, “The administrative question, therefore, is whether a trial court may employ an order denominated as a ‘status quo ante order’ to grant relief that, in substance and effect, suspends the implementation of a wage order notwithstanding the prohibition under Article 126 of the Labor Code.”
Dagdag pa rito, “The jurisdiction of a regional trial court, and the means by which that jurisdiction is exercised, are conferred by law and by the Rules; they are not assumed, and a trial court cannot enlarge them by coining a remedy.”
Hiniling din nina Cendaña at ng mga labor group na maglabas ang SC ng administrative circular upang gabayan ang mga mababang hukuman sa tamang aplikasyon ng Article 126 ng Labor Code at ng mga tuntunin sa pansamantalang remedyo.
Ayon kay Cendaña, ang TRO ay “sets a very dangerous precedent,” dahil maaari rin itong mangyari sa ibang rehiyon. Binigyang-diin din niya na hindi dapat gamitin ng mga kumpanya ang mga korte upang maantala ang pagpapatupad ng mga wage order.
