TRO sa BFRVI-HOA elections

NAG-ISYU ang Human Settlement Adjudication Commission (HSAC) ng Temporary Restraining Order (TRO) para itigil ng BF Resorts Village Homeowners Association Inc. (BFRV-HOA Inc.) ang eleksyon ng Board of Directors for 2024-2026 sa June 23, 2024.

“Respondents or any persons acting in their behalf are likewise restrained from performing any or all acts relating or connected with the scheduling and conduct of any other election,” sabi sa Order

“The TRO shall be effective upon complainants posting of P50,000 bond to answer for whatever damages that the adverse party may sustain by reason of this Order, if it should later be decided that the complainants/applicants are not entitled thereto,” ayon pa rin dito.

Sa pag-iisyu ng TRO, iginiit ni Regional Adjudicator Atty. Joel Clamor na mas malaking pinsala sa complainants ang hindi pagbibigay ng relief na ito. Aniya, wala ring ibang sapat na remedyo sa batas ang complainants.

“A review of the allegations reveal that the matter is of extreme urgency and this office is convinced that the applicants will suffer immediate irreparable injury if the election for the 2024-2026 Board of Directors of BF Resort Village HOA Inc. on June 23, 2024, will push through,” idiniin ni Clamor.

Sa pagpapatupad ng TRO, inatasan ni Clamor ang sheriff-in- charge na makipag-ugnayan sa Philippine National Police (PNP) o anumang ahensuya sa peace and order.

Nagbigay ang HSAC ng TRO sa petisyon nina Jose Deo Aguinaldo, Joan Compas-Batac at Aida Pineda, homeowners at residente sa nasabing Village.

Ang mga respondents ay sina Euan Rex Toralba, Michael Roxas, Angelo Ted Deimos, et.al.

Hiniling din ng complainants na ipatigil ang pagkilos ng Respondents bilang kasapi ng Board of Directors, Officers o representatives
at members ng Election Committee ng nabuwag ng BFRV-HOA Inc.

Hiniling din nila din sa Complaint na ipatigil ang pangagasiwa ng Respondents sa BFRV-HOA, Inc. at ang pagdedesisyon sa affairs, homeowners, residente, properties at assets nito at ang pagsasagawa ng eleksyon sa June 23, 2024 o anumang petsa.

Tinukoy sa Complaint na narepaso (expired) na
ang corporate term ng BFRV-HOA Inc. noong February 11, 2024, 50 taon makalipas ang incorporation nito noong 1974. RNT
