NILABAG ng Tsina ang international at domestic laws nang sinadyang banggain ng coast guard nito ang Philippine vessels at hinarass (harassed) ang tropa na nakasay sa isinagawang resupply mission sa Ayungin Shoal sa West Philippine Sea (WPS) isang linggo na ang nakalilipas.
Sinabi ni National Security Adviser (NSA) Secretary Eduardo Año na kabilang sa mga batas na nilabag ng Tsina ay ang Convention on Collision at Sea, International Convention for the Safety of Life at Sea (SOLAS) at Declaration on the Conduct of Parties in the South China Sea.
“Dapat dun lahat ng member states should exercise self-restraint and always opt [for] the use of peaceful means to settle disputes,” ayon kay Año.
Tinukoy din ni Año ang International Regulations for Preventing Collisions at Sea 1972, na itinakda, bukod sa iba pang mga bagay, ang ‘rules of the road o navigation rules’ na susundin ng mga barko o iba pang vessels para mapigilan ang banggaan.
Sa kabilang dako, ang SOLAS Convention ay itinuturing naman bilang “most important” sa lahat ng international treaties na may kinalaman sa kaligtasan ng merchant ships.”
Kabilang na rito ang probisyon ukol sa “safety of navigation, carriage of cargoes, at management of safety operations of ships,” bukod sa iba pa.
Samantala, ang Declaration on the Conduct of Parties in the South China Sea, nilagdaan ng Tsina at mga miyembro ng Association of Southeast Asian Nations sa Phnom Penh, Cambodia noong 2002, muling pinagtibay ang “freedom of navigation and overflight, peaceful settlement of disputes, at self-restraint sa pagsasagawa ng mga aktibidad.
Tinuran naman ni Foreign Affairs Undersecretary Ma. Theresa Lazaro na ang bilateral consultative mechanism sa labanan sa West Philippine Sea (WPS) sa pagitan ng dalawang bansa ay nakatakdang idaos sa Pilipinas “sometime in the near future”.
Ito ang pangalawang pagpupulong sa pagitan ng dalawang partido simula Enero.
“There were discussions and some confidence-building measures that have been formulated,” ayon kay Lazaro.
“And now we are… it’s just that there are certain possibilities of us meeting again sometime in the near future. But this is to complement what has been… it is a very important aspect, is really the diplomatic front,” dagdag na wika nito. Kris Jose
