MANILA, Philippines – Nilinaw ni Batangas Rep. Gerville Luistro na hindi ibinaba ang two-thirds requirement para mahatulan si Vice President Sara Duterte sa impeachment trial.
Ayon kay Luistro, lead public prosecutor sa impeachment trial, nilinaw lamang ng Senate impeachment court kung sinu-sino ang kabilang sa “all members of the Senate” na gagamitin sa pagkukuwenta ng boto.
“The threshold was not lowered, two-thirds remains two-thirds,” ani Luistro.
Kabilang sa maaaring hindi isama sa bilang ang mga senador na detained, suspended o legal na hindi makaganap bilang senador; mga pinaghahanap na hindi alam ang kinaroroonan; may physical o medical incapacity; at mga hindi saklaw ng coercive power ng Senado.
Nilinaw din ni Luistro na ang bilang ng mga kwalipikadong senator-judge ay titingnan sa oras ng pagboto. Dahil dito, maaari umanong makaboto si Sen. Loren Legarda kung makakabalik siya sa trabaho bago ang hatol.
“If she will return and she will be present at the time of vote, following that ruling, consistent to that ruling, I think she should be considered to be allowed to vote,” ani Luistro.
Matapos ang oral arguments noong Miyerkules, 13 senator-judge na dumalo ang bumoto upang payagan ang pagkukuwenta ng two-thirds batay sa mga miyembro ng impeachment court na legal at aktuwal na makadadalo sa botohan.
Ayon kay Presiding Officer at Senator-judge Francis Escudero, kailangang i-round up ang resulta kung may decimal. Halimbawa, kung 20 senator-judge lamang ang kwalipikadong bumoto, ang two-thirds na 13.33 ay magiging 14 na boto.
Nasa Article XI, Section 3(5) ng 1987 Constitution na kailangan ang “concurrence of two-thirds of all the Members of the Senate” para ma-convict ang isang impeached official. Karaniwan, 16 na boto ang two-thirds ng 24 na senador.
Bukod kay Legarda, hindi rin dumalo sa alinmang araw ng trial sina Senators Jinggoy Estrada, Rodante Marcoleta at Ronald dela Rosa. Sina Estrada at Marcoleta ay detained kaugnay ng magkahiwalay na plunder cases, habang si dela Rosa ay hindi nagpapakita sa publiko amid an arrest order mula sa International Criminal Court. RNT/MDS
